ORDER DENYING CONTINUANCE

By Order dated October 8, 2023, the hearing in this matter was continued to October 27, 2023 at 9:00 a.m. and set for Virtual session.

On October 26, 2023, Respondent filed a last-minute and ex-parte motion for a continuance indicating that, due to recent emails and/or conversations between some persons, Respondent presumed there had been a pre-denial of a future application and Respondent indicated a need for additional time to determine how to proceed.

The administrative hearing set for October 27, 2023 concerns Respondent’s appeal of the Department’s July 14, 2023 Cease & Desist ORDER. The scheduled administrative hearing will not address any other issue.

In this case, because the request is last minute and ex-parte,

IT IS ORDERED denying the request for a continuance. The parties should appear at the Virtual hearing; it is possible that additional discussion at that time regarding the matter may result in the hearing session being converted to a pre-hearing session.
