MINUTE ENTRY - GRANTING CONTINUANCE
Pending before the Office of Administrative Hearings is the parties’ Stipulation to Continue Hearing Date and Corresponding Deadlines for a Period of Sixty Days (Motion). In the Motion, the parties indicate Respondent’s prior counsel had been engaged in settlement discussions with the State and that Respondent’s newly acquired counsel would like to continue those discussions.
The parties requested that the four-day hearing be reset approximately 60 days out; however, to preserve administrative resources, the matter will be set for a status update to allow the parties to pursue the settlement discussions.
Accordingly, the hearing and related deadlines in the above-entitled matter are continued and the matter is set for a Status Update on November 30, 2023. On or before this date, the parties are advised to do one of the following:
(1) Inform the tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;
(2) Inform the tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or
(3) Inform the tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
