ORDER VACATING

HEARING

On August 10, 2023, at 11:00 a.m., a prehearing conference regarding the above-captioned matter convened. Petitioner Heather Settle appeared on her own behalf. Assistant Attorney General Kyle Cummings represented the Arizona Secretary of State.

Mr. Cummings informed the Tribunal that the Arizona Secretary of State withdrew the denial of Petitioner’s application for Notary Public Commission. Based on the withdrawal of the denial for which Petitioner filed her appeal, the parties agreed that the hearing currently scheduled for August 24, 2023, at 9:00 a.m., can be vacated.

Based on the above and sufficient cause appearing,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Arizona Secretary of State for further action.
