A hearing in the above-entitled matter was held on June 27, 2022.

Petitioner David G. Iadevavia requested to provide a rebuttal closing argument after the record was closed on June 27, 2022. Respondent Ventana Shadows Homeowners Association, Inc. filed an objection to an oral closing argument but proposed that the parties submit written closing arguments.

Petitioner is not entitled to a rebuttal closing argument pursuant to the rules that govern hearings at the Office of Administrative Hearings. See Arizona Administrative Code R2-19-116. Furthermore, Petitioner did not request a rebuttal closing at the time of the hearing. Notwithstanding, having considered the Motion and the Response,

IT IS ORDERED that the record in this matter is reopened until July 29, 2022 for the sole purpose of receiving written closing arguments. Petitioner must submit a written closing argument no later than July 15, 2022. Respondent must submit its written closing argument no later than July 22, 2022. Petitioner may submit a reply no later than July 29, 2022.
