On June 3, 2022, Petitioner filed with the Office of Administrative Hearings a Motion to Vacate/Withdraw Hearing, and attached a Homeowner’s Association (HOA) Dispute Process Petition Withdrawal Request (“Withdrawal”) dated May 21, 2022, and a copy of the Notice of Hearing issued by the Department of Real Estate (“Department”) on May 17, 2022. The Withdrawal, signed by Petitioner, indicates the following:

Pursuant to Arizona Revised Statutes § 32-2199.01(A), the filing fee is refundable at the request of a Petitioner before a hearing is scheduled. If no hearing has been scheduled and - as the Petitioner - you seek to withdraw the petition, your filing fee may be refunded to you. If refunded, the matter will be closed and the petition dismissed.

Please confirm by signing below and returning this document. By doing so it is understood that you are withdrawing your petition, requesting a refund in the above referenced case and that you understand the method by which the filing fee will be returned.

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.
