MINUTE ENTRY - GRANTING CONTINUANCE

At the request of the parties, the hearing in the above-entitled matter is continued and set for a Status Update on September 29, 2023. On or before this date, the parties are advised to do one of the following:

(1) Inform the tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

(2) Inform the tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

(3) Inform the tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.

As the petition was filed on November 8, 2021, the mediation was held on August 24, 2022, and each subsequent status update since November 14, 2022, has provided only that the parties continue to work towards final terms and signing a final version of a settlement agreement which is perpetually “close to completion,” no further continuances will be granted. In the event the matter cannot be resolved by September 29, 2023, the Administrative Law Judge will set the matter for hearing.
