ORDER VACATING

HEARING

The undersigned Administrative Law Judge, having reviewed the documents Notice of Bankruptcy and Automatic Stay as filed by Respondent February 17, 2023, as well as Petitioner’s response received February 27, 2023, issues the following order:

Based on Respondent’s request that the above-captioned matter be stayed pending its voluntary bankruptcy pursuant to 11 U.S.C. § 362(a), and further noting Petitioner’s agreement and joinder to Respondent’s request, and given that it is unknown how long the underlying stay will remain in place and having no indication when, if ever, the related bankruptcy matter will be resolved and allow this administrative proceeding to move to proceed,

IT IS ORDERED, in light of the foregoing, this matter be vacated pursuant to Ariz. Admin. Code R2-19-111(4) and returned to the referring agency.

IT IS FURTHER ORDERED that the referring agency my resubmit the matter to the Office of Administrative Hearings for hearing once the applicable bankruptcy stay has been lifted.
