IT IS ORDERED that the Department’s Motion for Reconsideration, received January 09, 2026, is denied. Because the Department’s August 29, 2023, certified Final Administrative Decision was vacated and remanded back to the agency for further proceedings on July 07, 2025, in LC2023-000342-001 by Hon. Joseph Mikitish of the Maricopa County Superior Court, and because the Department failed to subsequently issue an Amended Final Administrative Decision; notwithstanding the satisfaction of monies paid to Appellant on or about October 02, 2025, it cannot reasonably be held that Appellant’s request for reopening to address the issue of attorney’s fees is statutorily barred as untimely.
