On April 6, 2022, counsel for Appellant Yuma Utilities Department, City of Yuma filed a Request to Vacate Hearing and Notice of Withdrawal with the Office of Administrative Hearings in which Appellant advised that it no longer wished to pursue the Notice of Appeal to the Director of the Arizona Department of Environmental Quality (Department) because it had reached an accommodation with the Department. As a result, the hearing currently scheduled to convene on May 11, 2022, is not necessary. Sufficient cause appearing,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Department for further action.
