On May 28, 2026, the Tribunal received multiple Motions from Respondent Deborah A. Cooney (Benton), pro se, which included a Motion to Compel Discover and Continue Hearing, Motion to Disqualify the Arizona Attorney General’s Office and for Appointment of Independent Prosecutor, Motion to Disqualify Exhibits, Motion to Vacate Order of Refuse to Renew and for Opportunity to be Heard, Motion to Dismiss all Complaints as Fruit of the Poisonous Tree, and a Motion in Limine to Exclude Expert Report of Dr. Stephen Borowsky and All Evidence Derived Therefrom.

On June 5, 2026, the Arizona State Board of Nursing (“Board”), by and through counsel, filed a Response to Pro Per Motions Filed by Respondent. In this response, the Board requested that Respondent counsel, Thomas Zimmerman, make it be known if he is still counsel for Respondent in these matters and if Mr. Zimmerman endorses or wishes to withdraw the motions filed by Respondent.

After consideration and review of the requests and motions,

IT IS ORDERED that Mr. Zimmerman inform the Tribunal and the Board whether or not he remains as counsel for Respondent by close of business on or before June 12, 2026.

IT IS FURTHER ORDERED that if Mr. Zimmerman remains Respondent’s counsel to inform the parties whether or not he endorses or wishes to withdraw the motions filed by Respondent pro per.

IT IS FURTHER ORDERED that if Mr. Zimmerman is no longer representing Respondent in this matter that he submit a Disengagement Letter, or the like to the Tribunal and the Board.

Once this information is ascertained, a briefing schedule will be established by the Tribunal.
