ORDER GRANTING CONTINUANCE

AND SETTING STATUS DATE

The hearing of this matter was scheduled to convene on May 5, 2026, at 3:00 p.m. On the date and at the time set for hearing, Eva Johnson, Chief Financial Officer, appeared on behalf of Complainant Red Mountain Mining. Sheila Puda, Vice-President, appeared on behalf of Respondent J and S Sand Spreaders, Inc.

The parties participated in a prehearing discussion outside of the presence of the Administrative Law Judge. Following that discussion, the parties advised the Tribunal that they had reached a resolution of the matter in dispute, however, required additional time in which to execute the terms of their agreement.

Therefore, good cause appearing, the hearing in the above-entitled matter is continued and set for a written Status Update on November 5, 2026. On or before this date, Ms. Johnson, on behalf of Complainant, is advised to do one of the following:

Inform the Tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

Inform the Tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

Inform the Tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
