ORDER OF DISMISSAL

On December 09, 2025, the Arizona Registrar of Contractors (“Registrar”) issued a Notice of Hearing on Contested Case (“Notice of Hearing”) setting an administrative hearing before the Office of Administrative Hearings (“OAH”), an independent state agency, at 9:00 a.m. on January 20, 2026, to determine whether grounds existed for the Registrar to take disciplinary action against ROC License No. 339134 for an alleged violation of Arizona Revised Statute (“Ariz. Rev. Stat.”) § 32-1154(A)(10). Correspondence was not returned as undeliverable to either party.

On January 05, 2026, Respondent submitted a Motion to Dismiss on the grounds that the underlying contract between the parties fell outside the scope of jurisdiction for the Registrar, as it was executed in 2020.

On January 05, 2026, the Tribunal advised Complainant to submit a written response to Respondent’s motion by January 12, 2026. Correspondence was not returned as undeliverable.

On January 13, 2026, Respondent submitted proposed Exhibits 1-4 in consideration of the scheduled hearing and to substantiate its pending motion.

To date, OAH has not received a response by or on behalf of Complainant to Respondent’s motion. Moreover, a request for additional time to reply has not been received by or on behalf of Complainant.

In light of the foregoing,

IT IS ORDERED that Respondent’s motion is granted. The above-captioned matter is hereby vacated from OAH’s calendar pursuant to Ariz. Admin. Code R2-19-111(4), and is remanded to the referring agency for further action, if any.

IT IS FURTHER ORDERED that 2025-09529 be closed by the Registrar, without prejudice.
