ORDER SETTING MATTER FOR WRITTEN STATUS UPDATE

The hearing of this matter was scheduled to convene on December 29, 2025, at 3:00 p.m. On the date and time set for hearing, Hector Fimbres appeared on behalf of Respondent F + F Construction, LLC. Complainant Insulation Contractors of Arizona, LLC did not appear. The Tribunal provided a fifteen (15) minute grace period for Complainant to appear. However, Complainant did not appear. Thereafter, Mr. Fimbres informed the Tribunal that the parties had entered into a settlement agreement, that Respondent only had two outstanding payments remaining to be paid, and that could have been the reason for Complainant’s non-appearance. Given Complainant’s non-appearance, Mr. Fimbres made a motion to dismiss the filed Complaint.

On December 29, 2025, at 3:48 p.m., Respondent filed a Motion to Continue the hearing as follows: “I did not receive the portal email to join the hearing so I called in and they told me to fill out a motion for a new hearing date and or if the judge decides this would be necessary.”

In light of the parties’ potential settlement agreement and good cause appearing, in lieu of setting a continued hearing date at this time, this matter is continued and set for a written Status Update on February 13, 2026. On or before this date, Complainant is advised to do one of the following:

Inform the Tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

Inform the Tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

Inform the Tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
