ORDER DENYING MOTION TO DISMISS ON THE LACK OF STANDING GROUNDS

On March 24, 2026, counsel on behalf of JTI Construction, LLC, (“Respondent’) filed a Motion to Remand Case to Arizona Registrar of Contractors. This Administrative Law Judge (“ALJ”) asserts jurisdiction to hear this matter and Respondent can present any affirmative defense at the Tribunal.

On March 25, 2026, counsel on behalf of Respondent filed a Motion to Dismiss. This ALJ asserts that the Arizona Registrar of Contractors (“Registrar”) has the authority to investigate Complainant’s complaint in this matter, regardless, of how title to the property was held or who filed the complaint.

IT IS ORDERED both Motions are denied. The April 14, 2026, hearing will move forward as scheduled.
