STATUS DATE

At the hearing conducted on March 18, 2026, the parties discussed the remaining Directive items and both Ms. Nelson and Respondent agreed to allow additional time for those remaining items to be corrected prior to an Administrative Law Judge recommended decision in this matter being issued.

On March 20, 2026, the Tribunal issued an ORDER for a status update no later than April 24, 2026:

Therefore, at the request of the parties, and good cause appearing, the hearing in the above-entitled matter is continued for a status update no later than April 24, 2026 from the parties whether the matter is resolved and may be vacated, additional time is needed for items to be corrected, or the matter should proceed to recommended decision based on the March 18, 2026 administrative record.

Not hearing from the parties, on May 1, 2026, the Tribunal issued another ORDER for a status update no later than May 8, 2026.

On May 11, 10226, counsel for Respondent filed an update indicating as follows:

[I]t has completed all of the remaining items at Complainant’s residence and

understands that Complainant is satisfied with the work. Undersigned counsel has attempted to send an email to confirm with Complainant that this matter is resolved and can be vacated but has not received a response, but Respondent has reported to counsel that Complainant is satisfied with the work.

On May 13 and 15, 2026 the Tribunal reached out to Complainant by email and by phone regarding the status of the matter and whether the corrective work was performed in this interim period and whether the work was to her satisfaction, as was stated by Respondent. The Tribunal has not heard from Complainant.

Given the time frame that has been allowed and in the absence of a response from Complainant indicating that this Complaint is resolved and may be vacated, a recommended decision will be issued by the Administrative Law Judge in this matter based on the hearing record created on March 18, 2026. The matter will not be reopened for additional evidence.

Based on the foregoing,

IT IS ORDERED that Complainant file her response to the Tribunal, and copy Respondent, regarding the May 11, 2026 filing by Respondent no later than June 12, 2026, whether this matter is resolved and can be vacated.
