ORDER DENYING CONTINUANCE
Pending before the Office of Administrative Hearings is Respondent’s August 4, 2026 Motion to Continue the hearing scheduled on August 5, 2026, at 1:00 p.m. Respondent requests a continuance of the hearing for the following reasons:
The Respondent is not adequately prepared to proceed with the hearing as currently scheduled. In addition, a key employee whose testimony and participation are necessary to present the Respondent's case is unavailable to attend on the scheduled hearing date due to a prior commitment that cannot be changed.
A continuance is requested to allow sufficient time to prepare the case and to ensure that all necessary witnesses are available to participate, so that the matter may be fully and fairly presented.
A.A.C. R2-19-106(C) sets forth:
Time Limits. Absent good cause, or unless otherwise provided by law or these rules, written motions shall be filed with the Office at least 15 days before the hearing. A party demonstrates good cause by showing that the grounds for the motion could not have been known in time, using reasonable diligence and: 1. A ruling on the motion will further administrative convenience, expedition or economy; or 2. A ruling on the motion will avoid undue prejudice to any party.
The Arizona Registrar of Contractors issued the Notice of Hearing for this matter on June 23, 2026, advising the parties of the hearing date and time. On June 30, 2026, the Office of Administrative Hearings issued an Order reiterating the date and time of hearing, and providing the Google Meet information to the parties. Therefore, Respondent has been on notice of the pending hearing since June 23, 2026, waited until the day before the hearing to file its Motion, and provided no explanation for failing to timely file its Motion.
Upon review and consideration of the Motion and no good cause appearing,
IT IS ORDERED DENYING the Motion.
The matter remains scheduled for August 5, 2026, at 1:00 p.m., and will be conducted either by video conferencing or telephone participation through Google Meet as follows:
