ORDER GRANTING CONTINUANCE

On June 11, 2025, Respondent filed a Notice of Settlement (Notice). Through the Notice, the parties requested that the, “hearing in this matter be held in abeyance and that the Office of Administrative Hearings retain the file pending completion of the settlement.” The parties further requested through the Notice, “As a condition of the Parties agreement, Complainant here consents to have the suspension of Respondent’s license lifted, in order that Respondent may be able to engage in work as is to satisfy the settlement. The Parties request that an interim Order to the Registrar of Contractors to recommend that the suspension be lifted.”

On June 12, 2025, at the time set for hearing, Respondent’s counsel appeared for the hearing and notified the Administrative Law Judge (ALJ) that a notice of settlement had been filed with the tribunal. No one appeared on behalf of Complainant. The ALJ notified Respondent’s counsel that the hearing would be vacated and remanded to the Registrar of Contractors (Registrar).

Upon further review of the Notice, the ALJ concludes that the matter can be set for a status update pursuant to the request of the parties. However, the ALJ lacks jurisdiction to recommend that the current suspension be lifted. Therefore,

IT IS ORDERED that the request to recommend that the Registrar lift the current suspension of Respondent’s license is denied. Accordingly, the ALJ will not remand the matter to the Registrar at this time.

IT IS FURTHER ORDERED that the hearing in the above-entitled matter is continued and set for a Status Update Only on June 1, 2026. On or before this date, the parties are advised to do one of the following:

(1) Inform the tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

(2) Inform the tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

(3) Inform the tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
