TRIBUNAL TO REQUIRE STATEMENT
FROM REGISTRAR REGARDING
APPLICABILITY OF A.R.S. § 41-
1092.08(I)
Pending before the Tribunal is Freedom Construction & Design, LLC’s (“Respondent”) Request for Tribunal to Require Statement from Registrar Regarding Applicability of A.R.S. § 41-1092.08(I), the Arizona Registrar of Contractors’ (“Registrar”) Motion to Strike Respondent’s Request for Tribunal to Require Statement, and Respondent’s Response to Motion to Strike.
Upon review and consideration,
IT IS ORDERED DENYING Respondent’s Request for Tribunal to Require Statement from Registrar Regarding Applicability of A.R.S. § 41-1092.08(I). The Tribunal does not have the authority to compel the Registrar to provide the requested “Statement.” The Office of Administrative Hearings is tasked with holding hearings that are referred to it by State Agencies, Boards, and Commissions. It is not within the purview of the Office of Administrative Hearings to require the Registrar to state its position on a matter that is unrelated to the issue as set forth in the Notice of Hearing. The Notice of Hearing sets forth the issue for hearing as follows:

The statutes and rules the Respondent is alleged to have violated are cited in the complaint and citation, which were served on the Respondent on August 4, 2025.
SHORT AND PLAIN STATEMENT OF THE MATTERS ASSERTED
The complaint and citation allege that the Respondent committed the following act(s):
Charge: 1 A.R.S. § 32-1154(A)(12) - A.R.S. § 32-1158
The requested “Statement” is in regard to how a Decision is treated by the Registrar post-hearing. Notably, it is the Office of Administrative Hearings’ practice in these types of cases to certify a Decision when a licensee provides notice to the Office of Administrative Hearings, within ten days of the issuance of a Decision, that it has accepted the Decision.
