On November 25, 2025, Respondent, by and through Counsel, filed a motion for issuance of a subpoena, pursuant to A.R.S. § 41-109207(C). The motion seeks a subpoena duces tecum to compel Complainant to produce, among other things, the “complete file. . .including but not limited to. . .anyone else connected to the project. . .all [communication] between members, Directors, Officers or the Board of the HOA regarding the project. . .all [communication] between members, Directors, Officers or the Board of the HOA and AAM LLC, aka Associated Asset Management LLC and its officers, directors, managers, supervisors and employees regarding the project. . .” The request is overly broad in scope, not limited only to the issue before this Tribunal. It is unreasonable and oppressive and Respondent has not demonstrated that the probative value of the requested documents outweighs the burden to the Complainant. Accordingly, Respondent’s motion for issuance of subpoena duces tecum to Complainant is DENIED.1
