HEARING

The above-captioned matter was initially set for hearing for October 29, 2025. At the time of the scheduled hearing, it was determined that Respondent had completed corrective work after the compliance period ended and a citation was issued. Therefore, the hearing was continued to December 15, 2025, to allow Investigator Anderson an opportunity to conduct a pre-hearing inspection.

On December 15, 2025, at the time of the scheduled hearing, all parties appeared. Investigator Anderson informed the Tribunal that all corrective work had been completed to ROC standards and no complaint items remained outstanding; therefore, the hearing was not necessary. On the record, Complainant and Respondent affirmed Investigator Anderson’s determination that no issues remained in dispute and the scheduled hearing was not necessary.

Sufficient cause appearing,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the referring agency for further action.
