ORDER REQUIRING ORAL ARGUMENT AT TIME SCHEDULED FOR HEARING REGARDING RESPONDENT’S MOTION IN LIMINE

The above-captioned matter is set for hearing on January 5, 2026. On December 29, 2025, Respondent filed a Motion in Limine to exclude evidence and argument regarding prior acts, discipline, or proceedings involving unrelated entities or different qualifying parties. Respondent argues that Complainant’s Exhibits 2 and 4 as disclosed in the prehearing disclosure statement were proffered to suggest a pattern of misconduct or bad character by association rather than to prove any element of the alleged violations in the instant matter.

Complainant has not filed a response in opposition to Respondent’s Motion in Limine. As Respondent’s Motion was received only days before the scheduled hearing, though the prehearing disclosure was filed in November 2025, the undersigned Administrative Law Judge (ALJ) will hear oral argument from both parties as to the purpose of the proffered evidence. Arguments regarding Respondent’s Motion in Limine will be heard as a preliminary matter prior to the start of the scheduled hearing.
