ORDER VACATING

HEARING

The hearing of this matter convened on October 21, 2025, at 1:00 p.m. Complainant Richard Bui appeared on his own behalf with his friend, Landon Rodger. Julien Flores appeared on behalf of Respondent TuStrong Contracting, Inc., with Elijah Colon, a subcontractor. Arizona Registrar of Contractors Investigator Gregory Johndrow appeared as a witness.

Prior to the commencement of the hearing, the parties were provided with an opportunity to discuss resolution. That discussion was unsuccessful and did not result in a resolution. Consequently, the matter proceeded to hearing. The parties provided their respective opening statements, and Investigator Johndrow presented his testimony. The parties were provided an opportunity to question Investigator Johndrow, and thereafter, Investigator Johndrow was excused. Mr. Bui provided his testimony. During cross examination of Mr. Bui, Mr. Flores proposed that the parties further discuss a resolution. The Administrative Law Judge provided that opportunity to the parties during a recess.

Following the recess, the parties informed the Tribunal that they had reached a resolution of the matter, however, needed additional time in which to execute the terms of their agreement. The parties were advised that the matter would be set for a written Status Update in thirty (30) days. The parties were advised that in the event a hearing was requested, the hearing would re-convene at the point at which it was adjourned, specifically, with the cross-examination of Mr. Bui.

A Status Date was set for November 21, 2025. Mr. Bui did not file a Status Update until December 18, 2025, in which he advised the Tribunal:

I am disappointed to say that we have not really made progress. I would like to proceed with the hearing. I may be able to understand a little if the tile match isn't exact because it's been a couple of years but clearly there was no effort into matching the grout. The original grout color is white but TuStrong decided to use a brown color grout to complete the repair. This is indicative of the subpar work that we have received throughout the project.

In light of Mr. Bui’s request that the matter be re-set for hearing, on January 15, 2026, the Tribunal issued an Order Setting Further Hearing Via Google Meet, advising the parties that the further hearing in this matter would convene on March 4, 2026, at 1:00 p.m., and provided the Google Meet information to participate in the hearing either by video or by phone. The Order was sent to the parties’ respective email addresses of record used throughout these proceedings.

On March 4, 2026, at 1:00 p.m., neither party appeared for the further hearing notwithstanding a grace period provided. Neither party requested a continuance of the hearing, and neither provided a reason for their non-appearance.

On March 4, 2026, the Tribunal issued an Order Setting Final Status Date. That Order provided in pertinent part:

If Mr. Bui does not submit a status update by March 11, 2026, the Administrative Law Judge will conclude that the matter has been resolved or Mr. Bui does not wish to proceed with a hearing and the matter will be vacated.

Because Mr. Bui has not provided a status update,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the

calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Arizona Registrar of contractors for further action.
