ORDER GRANTING CONTINUANCE

AND SETTING STATUS DATE

The continued hearing of this matter was scheduled to convene on December 12, 2025, at 9:00 a.m. On the date and time set for continued hearing, Dennis Hart appeared on behalf of Complainant Sun Tech Glass, Inc. Ryan Bailey, Esq. represented Respondent FX Construction, LLC. Prior to the commencement of the hearing, the parties participated in a prehearing discussion outside of the presence of the Administrative Law Judge. Following that discussion, the parties advised the Tribunal that they had reached a resolution of the matter in dispute, however, needed additional time in which to execute the terms of their agreement. The parties requested that the matter be continued and set for a status date on March 1, 2026. The request was granted.

Therefore, good cause appearing, the hearing in the above-entitled matter is continued and set for a written Status Update on March 2, 2026. On or before this date, the parties are advised to do one of the following:

Inform the Tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

Inform the Tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

Inform the Tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
