ORDER DENYING RESPONDENT’S

MOTION TO COMPEL ACCESS FOR EXPERT INSPECTION

Pending before the Office of Administrative Hearings is Respondent’s Motion to Compel Access for Expert Inspection, and Complainant’s Objection thereto.

Upon review and consideration of both the Motion and response,

IT IS ORDERED DENYING the Motion.

Pursuant to A.R.S. § 32-1155(D)(1), a contractor must be allowed, upon request, the opportunity to inspect the work complained of within fifteen (15) days of receiving

notice from the Arizona Registrar of Contractors of the filed Complaint. After such time period, a complainant is under no obligation to provide access for inspection. The Office of Administrative Hearings does not have the authority to order a complainant/homeowner to provide access to their property.
