ORDER DENYING MOTION FOR ISSUANCE OF SUBPOENA DUCES TECUM

Complainant filed a motion for issuance of subpoena duces tecum pursuant to A.R.S. § 41-1092.07(C). The motion seeks to compel Respondent to produce employment verification documentation for Vincent Lopez and Michael Meshier. Specifically, Complainant seeks, for each individual, a copy of the “W-2 for 2024.” Complainant has not demonstrated that the requested information is necessary and relevant to the issue(s) before this Tribunal, and therefore the probative value of the requested documents outweighs the burden to the Respondent. The information Complainant seeks may be provided as sworn testimony at hearing.

Accordingly, Complainant’s motion for issuance of subpoena duces tecum to Respondent is DENIED.
