The Notice of Hearing on Contested Case (“Notice of Hearing”) that was issued in the above-captioned matter was sent to the parties on May 05, 2025, which was not returned as undeliverable to Respondent. Additionally, the Hearing Order that was issued by the Tribunal regarding this matter was sent to the parties on May 07, 2025, which was also not returned as undeliverable to Respondent.
Respondent’s reason for requesting a continuance, being “out of town,” is not a sufficient basis for the Tribunal to grant its request. Respondent’s reconsideration request, which alleged Complainant’s disclosure affords it “insufficient time to properly review and prepare” for these proceedings, is also an improper basis to grant Respondent’s request, as Complainant’s disclosure is in full compliance with Ariz. Admin. Code R2-19-118; R2-19-108. (See Notice of Hearing, page 5 – Disclosure Statement.)
In light of the foregoing,
IT IS ORDERED that Respondent’s request for reconsideration regarding its June 02, 2025, Motion to Continue is denied.
