On March 07, 2025, the Arizona Registrar of Contractors (“Registrar”) issued a Notice of Hearing on Contested Case (“Notice of Hearing”) that set an administrative hearing before the Arizona Office of Administrative Hearings (“OAH”), an independent state agency, to determine whether grounds exist for the Registrar to take disciplinary action against ROC License No. 336811 based on Respondent’s alleged violation(s) of Arizona Revised Statute § 32-1154(A)(10), as set forth in a Citation issued to Respondent on February 13, 2025, based on Complaint 2025-00791 which was received by the Registrar on or about January 28, 2025. Correspondence was not returned as undeliverable to either party.
On March 12, 2025, OAH issued a Hearing Order to the parties that provided videoconference and teleconference information to facilitate remote participation. Correspondence was not returned as undeliverable to either party.
On April 10, 2025, though afforded a fifteen (15) minute grace period after the time scheduled for hearing, Complainant failed to appear.
No correspondence was received on by or on behalf of Complainant to provide notice of unavailability, appear via alternative means, or continue proceedings.
No settlement is on file for this matter at OAH.
In light of the foregoing,
IT IS ORDERED pursuant to Arizona Administrative Code R2-19-111(4), R2-19-117, and R2-19-119 that this matter is hereby vacated from OAH’s calendar.
IT IS FURTHER ORDERED that this matter is remanded to the referring agency for closure of Complaint No. 2025-00791, without prejudice.
NOTICE
In the event of certification of the Administrative Law Judge Decision by the Director of the Office of Administrative Hearings, the effective date of the Order will be forty (40) days from the date of that certification.
