FINDINGS OF FACT
On July 14, 2025, the Arizona Registrar of Contractors (hereinafter “Registrar”) issued a Final Administrative Decision and Order that adopted the June 23, 2025 Recommended Decision of Administrative Law Judge Velva Moses-Thompson in case no. 2024A-13648-CHC-ROC.
On August 1, 2025, the Registrar issued an Order Granting Request for Rehearing or Review for the following reasons:
............the Registrar received Respondent’s request for rehearing, which indicated that Respondent had not received the Notice of Hearing that had been mailed. A review of the file shows that the Notice of Hearing issued in this matter did not list all addresses for the Respondent that were listed in the Citation and the Final Administrative Decision and Order.
On August 15, 2025, a Notice of Hearing on Contested Case was issued to all parties setting the above-entitled matter, (Case No. 2024A-13648-CHC-ROC-RHG), for rehearing on September 24, 2025 at 1:00 p.m.
The August 15, 2025 notice was mailed to Respondent at all addresses for the Respondent that were listed in the Citation and the Final Administrative Decision and Order.
On September 10, 2025, Kevin Collins, Respondent’s qualifying party, filed a motion to continue the hearing date with the tribunal from the e-mail address “[email redacted]”.
6. Complainant filed an objection to the motion.
7. On September 16, 2025, the Administrative Law Judge issued an order denying the motion for lack of good cause. The notice of denial provided a phone number and a video link whereby Respondent could connect to the hearing through Google Meet by telephone or video. The denial was sent to Mr. Collins at the e-mail addresses: “[email redacted]” and “[email redacted]”.
8. No one appeared on behalf of Respondent at the rehearing scheduled for September 24, 2025.
9. Although afforded a fifteen (14) minute grace period, no representative for Respondent appeared at the hearing. Consequently, the hearing was not convened, and no evidence was taken.
10. There is no evidence that Respondent subsequently contacted the Office of Administrative Hearings to provide an explanation for not appearing at the scheduled rehearing.
CONCLUSIONS OF LAW
By failing to appear at the rehearing, Respondent failed to present evidence to support its position.
RECOMMENDED ORDER
Based on the foregoing, it is recommended that on the effective date of the Registrar of Contractors’ Order, the June 23, 2025 Recommended Decision of Administrative Law Velva Moses-Thompson in case no. 2024A-13648-CHC-ROC be accepted.
Pursuant to A.R.S. § 41-1092.08(I), the licensee may accept the Administrative Law Judge Decision by advising the Office of Administrative Hearings in writing not more than ten (10) days after receiving the decision. If the licensee accepts the Administrative Law Judge Decision, the decision shall be certified as the final decision by the Office of Administrative Hearings.
In the event of certification of the Administrative Law Judge Decision by the Director of the Office of Administrative Hearings, the effective date of the Order will be forty (40) days from the date of that certification.
