SETTING STATUS DATE

The hearing of this matter was scheduled to convene on May 13, 2025, at 1:00 p.m. On the date and time set for hearing, Complainant Nicole Pinazza appeared on her own behalf. Jason Kush appeared on behalf of Respondent J P Kush Construction, LLC. Matt Hyde appeared as a witness. The parties participated in a prehearing discussion outside of the presence of the Administrative Law Judge. Following that discussion, the parties advised the Tribunal that they entered into a settlement agreement, however, needed additional time in which to execute the terms of the agreement.

Therefore, good cause appearing, the hearing in the above-entitled matter is continued and set for a written Status Update on May 19, 2025. On or before this date, Complainant, Ms. Pinazza, is advised to do one of the following:

Inform the Tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

Inform the Tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

Inform the Tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
