ORDER
On May 09, 2025, the Arizona Registrar of Contractors (“Registrar”) referred the above-captioned matter to the Office of Administrative Hearings (“OAH”), an independent state agency, for an evidentiary hearing on July 01, 2025. Per the May 21, 2025, Notice of Hearing the issues to be determined were whether the Registrar has cause to discipline Respondent’s license based on the following alleged statutory violations:
Charge 1: A.R.S. § 32-1154(A)(3) – A.A.C. R4-9-108(a)
Charge 2: A.R.S. § 32-1154(A)(22)
On June 04, 2025, per Complainant’s request, an Order Granting Continuance was issued which reset the matter for hearing on July 24, 2025.
On July 25, 2025, per the joint request of the parties, an Order Granting Continuance was issued which reset the matter for hearing on September 16, 2025.
On September 16, 2025, an administrative hearing took place whereby both parties appeared and presented evidence, upon the conclusion of which the hearing record was closed.
On September 29, 2025, a Recommended Administrative Law Judge Decision was issued to the Director of the Registrar, which held the following, in pertinent parts:
IT IS RECOMMENDED that that on the effective date of the Final Order in this matter, Respondent Skye Builders LLC, ROC License No. 309790, shall be suspended for fourteen (14) business days based on its violations of Ariz. Rev. Stat. §§ 32-1154(A)(3) and 32-1154(A)(22).
It is further recommended that Respondent submit a construction contract template to the Registrar that complies with requirements set forth in Ariz. Rev. Stat. § 32-1158 within five (5) days of the effective date of the Final Order in this matter.
It is further recommended that the Registrar require Respondent to pay the sum total of $500.00 (five hundred fifty dollars) in certified funds as a civil penalty pursuant to Ariz. Rev. Stat. § 32-1154(E).
It is further recommended that if Respondent fails to pay the entire amount of the civil penalty on or before thirty days following the effective date of the Registrar’s Order, the Registrar revoke Respondent’s license, effective on such deadline date. No future license shall be issued to any entity consisting of persons associated with Respondent, as defined in Ariz. Rev. Stat. § 32-1101(A)(5), unless Respondent tenders payment of any outstanding prior civil penalty.
NOTICE
Pursuant to Ariz. Rev. Stat. § 41-1092.08(I), the licensee may accept the Administrative Law Judge Decision by advising the Office of Administrative Hearings in writing not more than ten (10) days after receiving the decision. If the licensee accepts the Administrative Law Judge Decision, the decision shall be certified as the Final Decision by the Office of Administrative Hearings.
In the event of certification of the Administrative Law Judge Decision by the Director of the Office of Administrative Hearings, the effective date of the Order will be forty (40) days from the date of that certification.

In response, on October 10, 2024, Respondent submitted a “formal response for the Court’s review,” wherein Respondent misidentified the parties as “Plaintiff vs. Defendant” and requested an opportunity to “present this defense” and have additional evidence considered. Respondent included a 4-page typed narrative and attached twenty-seven (27) additional pages consisting of multiple documents that were not presented at hearing.
Based on the foregoing,
IT IS ORDERED that Respondent’s submission is rejected, and its request for [re]consideration is denied. Respondent had a full and fair opportunity to present the totality of its evidence on September 16, 2025, whereupon the record was closed afterwards. Respondent’s request is inappropriately submitted, as no further action may be taken on the matter. Although the document will be retained in the file, it should not be responded to by any party.
