FINDINGS OF FACT

At the request of Respondent, the above-captioned matter was set to convene for hearing at 9:00 a.m. on September 24, 2025, at the Office of Administrative Hearings in Phoenix, Arizona via Google Meet.

The Notice of Hearing was mailed and emailed to both parties at their respective postal and electronic addresses of record. An Order detailing the Google Meet connection information and instructions was emailed to both parties at their respective electronic addresses. No mail, postal nor electronic, was returned as undeliverable for either party.

No representative for Respondent appeared or contacted the Office of Administrative Hearings by 9:15 a.m. and consequently, the matter was not convened and no evidence was taken.

CONCLUSIONS OF LAW

The burden of proof at an administrative hearing falls to the party asserting a claim, right or entitlement and the standard of proof on all issues in this matter is by a preponderance of the evidence. In the instant matter, Respondent bears the burden of proof to establish that the proposed payout from the Fund was incorrect by a preponderance of the evidence.

Because Respondent failed to appear and prosecute the appeal, the appeal was unsupported by evidence. Consequently, Respondent’s appeal should be dismissed.

ORDER

IT IS ORDERED that Respondent’s appeal is dismissed.

In the event of certification of the Administrative Law Judge Decision by the Director of the Office of Administrative Hearings, the effective date of the Order will be forty (40) days from the date of that certification.
