ORDER VACATING HEARING

On December 13, 2024, the Arizona Registrar of Contractors (“Registrar”) issued a Notice of Hearing on Contested Case setting an administrative hearing before the Office of Administrative Hearings (“OAH”), an independent State agency, at 9:00 a.m. on January 24, 2025, to determine whether grounds exist for the Registrar to take disciplinary action against Respondent for alleged violations of Ariz. Rev. Stat. § 32-1154(A)(1) and (A)(22). Correspondence was not returned as undeliverable to either party.

On December 16, 2024, OAH issued a Hearing Order that provided remote participation information for the parties, including a videoconference weblink and teleconference phone number and PIN code. Correspondence was not returned as undeliverable to either party.

On January 24, 2025, although afforded a 15-minute grace period, there was no appearance by or on behalf of Complainant. No Motion to Continue or appear via alternative means was received by or on behalf of Complainant either.

There is no settlement on file for this matter with OAH.

Therefore,

IT IS ORDERED that pursuant to Ariz. Admin. Code R2-19-117 and R2-19-111(4) this matter is hereby vacated from OAH’s calendar, without prejudice, and is remanded to the referring agency for the closure of Complaint No. 2024-10655.
