ORDER DENYING RESPONDENT’S MOTION TO RECLASSIFY
ORDER GRANTING CONTINUANCE
AND GOOGLE LINK FOR VIRTUAL APPEARANCE
On May 19, 2025, Sharp Manufacturing and Contracting LLC (“Respondent”) filed a Motion to Reclassify.
This Administrative Law Judge asserts that Respondent is a party to a contested case or appealable agency action and these administrative tribunal hearings are governed by Ariz. Rev. Stat. §§ 41-1092 et seq. and Ariz. Admin. Code R2-19-101 to R2-19-122. Furthermore, the authority is explicit in regards to the review of Office of Administrative Hearing administrative decisions per Ariz. Rev. Stat. § 41-1092.08.
In addition, pursuant to Ariz. Rev. Stat. § 41-1092.08(I), the licensee may accept the Administrative Law Judge Decision by advising the Office of Administrative Hearings in writing not more than ten (10) days after receiving the decision. If the licensee accepts the Administrative Law Judge Decision, the decision shall be certified as the final decision by the Office of Administrative Hearings.
It is Ordered that Respondent’s Motion to Reclassify is denied.
In addition, at the request of Respondent and good cause appearing, the hearing in the above-entitled matter is continued to July 22, 2025 at 1:00 PM.
