MINUTE ENTRY ADVISING PARTIES

On December 3, 2024, Complainant notified the Office of Administrative Hearings (OAH) in an ex-parte filing that, due to the time difference in her present location, the time for the January 9, 2025 hearing would need to be changed from 9:00 a.m. to 2:00 p.m. Arizona time.

Additionally, Complainant requested an explanation regarding the Registrar having set the matter for an administrative hearing given the stated “late filing” by Respondent. Based on the foregoing, the parties are advised:

The OAH is a separate state agency from the Registrar and conducts administrative hearings in matters that are forwarded to the OAH from multiple agencies, Boards and Commissions. In this case, the Registrar has determined to forward the matter for hearing; therefore, any questions regarding its determination to forward the matter to OAH should be directed to the Registrar.

Regarding a change in the hearing time, the matter would need to be continued to a different date on the OAH calendar, because no judges are available at 2:00 p.m. on that day to conduct the hearing. Complainant is advised that the typical time slot for these hearings begins at 1:00 p.m.; beginning at 1:00 p.m. typically provides a sufficient amount of time for hearing to be completed in one hearing session.

The hearing will be continued to a different date at 1:00 p.m. and a new ORDER will be sent to the parties. If Complainant will be back in Arizona or at different location at a particular date in the future, she should so advise OAH of such date as soon as possible.
