ORDER GRANTING CONTINUANCE

AND SETTING STATUS DATE

The hearing of this matter was scheduled to convene on November 4, 2025, at 9:00 a.m. On the date and at the time set for hearing, Brenton Pierson (“Complainant”) appeared on his own behalf. Michael Rolland, Esq. and Celeste Tabares, Esq. represented Fairway Homes West, Inc., doing business as F H W (“Respondent”). Chad Dennis and Matt McMahon were present on behalf of Respondent. Arizona Registrar of Contractors Investigator Gregory Kinsfather appeared as a witness.

The parties participated in a prehearing discussion outside of the presence of the Administrative Law Judge. Following that discussion, the parties advised the Tribunal that they had resolved the matters in dispute, however needed additional time in which to execute the terms of their agreement.

Therefore, good cause appearing, the hearing in the above-entitled matter is continued and set for a written Status Update on November 14, 2025. On or before this date, Complainant is advised to do one of the following:

Inform the Tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

Inform the Tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

Inform the Tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
