ORDER DENYING COMPLAINANT’S MOTION TO SUBSTITUTE

On April 7, 2025, Superstition Contracting Inc., Respondent, through its counsel filed a Motion to Dismiss (Standing). This Administrative Law Judge (“ALJ”) asserts that the Arizona Registrar of Contractors (“Registrar”) has the authority to investigate Complainant’s complaint in this matter, regardless, of how title to the property was held.

On April 11, 2025, Lori Denise McCallister, Complainant, through her counsel filed a Motion to Substitute Party. Due to the reasoning in this ALJ’s brief response to Respondent’s Motion to Dismiss, the Complainant’s Motion to Substitute Party is also denied.

In addition, multiple subpoena requests were issued by Respondent’s counsel and uploaded some time to the Office of Administrative Hearings portal on April 16, 2025. This ALJ had the opportunity to review them on April 17, 2025 and commanding individuals to appear for a hearing on April 21, 2025, does not provide them with a reasonable opportunity to appear. Voluntary appearance is an option or seeking a continuance/postponement pursuant to Ariz. Admin. Code R2-19-110.

IT IS ORDERED both Motions are denied.
