This Notice of Hearing is issued under A.R.S. § 41-1092.05(D). HEARING INFORMATION The hearing is set for:

November 19, 2024 9:00 AM Kay Abramsohn Google Meet. A link will be provided directly from The Office of Administrative Hearings. Go to www.azoah.com to request to appear in-person.

If you have requested to appear in-person at the hearing, the hearing will be held at 1740 W Adams Street, Phoenix, AZ 85007.

You must attend this hearing. This is an adversarial hearing before an administrative

law judge, and is conducted in a similar manner as judicial proceedings. Thus, you must be

prepared to present evidence, including witness testimony and documents, in support of your case.

STATEMENT OF LEGAL AUTHORITY AND JURISDICTION

The State of Arizona has determined that the licensing and regulation of construction contractors is a proper state function, and has vested authority in the Registrar of Contractors to administer Title 32, Chapter 10 of the Arizona Revised Statutes. A.R.S. §§ 32-1101 et seq. All hearings for alleged violations of Title 32, Chapter 10 are conducted under Title 41,

Chapter 6, Article 10. A.R.S. § 32-1156.

The statutes and rules governing the hearing can be found at: Arizona Revised

Statutes §§ 41-1092 to -1092.12, and Arizona Administrative Code R2-19-101 to -122.

PARTICULAR ARIZONA STATUTES AND RULES INVOLVED

The statutes and rules the Respondent is alleged to have violated are cited in the

complaint and citation, which were served on the Respondent on September 16, 2024. SHORT AND PLAIN STATEMENT OF THE MATTERS ASSERTED

The complaint and citation allege that the Respondent committed the following act(s): Charge: 1 A.R.S. § 32-1154(A)(10)

THE PARTIES TO THE ADMINISTRATIVE HEARING Because Respondent is a licensee and is charged with an act(s) or omission(s) that is cause for the suspension or revocation of a license, Respondent is a party to this case and will be a party to the hearing. Because Complainant alleged Respondent committed an act(s) or omission(s) that is cause for the suspension or revocation of a license, Complainant is a party to this case and will

be a party to the hearing.

Respondent and Complainant, as the parties to the hearing, will present evidence and

argument to the administrative law judge.

RIGHT TO BE REPRESENTED The parties to the administrative hearing may choose to be represented by an attorney. A.R.S. § 41-1092.07(B). If one of the parties is a company, the company may be represented

by an officer or employee if that person satisfies the conditions set forth in A.R.S. § 32-

1156(B).

CHANGE OF ADDRESS Each party must inform the Registrar and the Office of Administrative Hearings of any change of address within five (5) days of the change. A.R.S. § 41-1092.04.

HEARING PROCEDURES AND RULES

The administrative hearing will be conducted in accordance with A.R.S. §§ 41-1092 to -1092.12, and A.A.C. R2-19-101 to -122. The parties should review the statutes, rules, and

processes governing the administrative hearing. Copies of the statutes, rules, and articles regarding the administrative hearing process can be found at https://www.azoah.com/.

REGISTRAR’S APPEARANCE BY VIDEO CONFERENCE OR TELEPHONE

The Registrar’s investigators, employees, and attorneys will appear at the hearing via

video conference or telephone unless requested by a party to appear in-person. Requests for the Registrar’s investigators, employees, or attorneys to appear in-person must be filed with the Registrar and the Office of Administrative Hearings no later than seven (7) calendar days prior to the hearing date.

HEARING PACKET

In the interests of administrative efficiency, the Registrar compiles and discloses

certain documents to the parties and the Office of Administrative Hearings. These documents

are attached to this Notice of Hearing as the “Hearing Packet.” If any party wishes to submit additional evidence, they must do so during the hearing after completing a disclosure statement. See “Disclosure Statement” section below.

SUBPOENAS FOR TESTIMONY FROM A WITNESS OR DOCUMENTS

The parties to the hearing must be prepared to present evidence in support of their

case. If a party wants to obtain testimony from a witness or documents not in the party’s

possession, the party must prepare and file a written subpoena for the Administrative Law

Judge to review and sign, if approved. A.R.S. § 41-1092.07(C). Forms for requesting a subpoena can be found on the Office of Administrative Hearings’ website at www.azoah.com.

The party seeking a subpoena must serve notice on all the parties to the hearing, and on the Registrar. A.R.S. § 41-1092.04.

DISCLOSURE STATEMENT

At least seven calendar days before the hearing, each party must prepare and serve a

disclosure statement on all other parties, and file it with the Office of Administrative Hearings. A.A.C. R4-9-118; A.A.C. R2-19-108. The disclosure statement must include any exhibit the party will use at the hearing. A party’s failure to timely disclose any witness or exhibit, without good cause, may result in the administrative law judge excluding those witnesses or exhibits from being used at the hearing. CHANGING THE HEARING DATE

The date of the hearing may only be advanced or delayed on the agreement of the

parties or on a showing of good cause. A.R.S. § 41-1092.05(C). The date of the hearing may

be changed by filing a written agreement of the parties to change the date of the hearing. The

written agreement must be filed with the Office of Administrative Hearings, directed to the assigned Administrative Law Judge, and transmitted to the Registrar and all other parties. The assigned Administrative Law Judge may be found on the Office of Administrative Hearings’ web portal at www.azoah.com

If a party would like to move the date of the hearing without agreement of all parties, the party must file a written motion with the Office of Administrative Hearings, directed to the assigned Administrative Law Judge, and transmit a copy to the Registrar and all other parties. The motion must state in detail good cause for why the date of the hearing should be advanced or delayed, and the position of all other parties regarding the advancement or delay. A party may also file a motion asserting a right to an expedited hearing upon a showing of

extraordinary circumstances or the possibility of irreparable harm. A.R.S. § 41-1092.05(E).

RESOLUTION SHORT OF ADJUDICATION In any case which is resolved or settled by the parties, or which is withdrawn by the Complainant without objection from Respondent after the Notice of Hearing is issued, the parties must notify the Office of Administrative Hearings of the resolution or settlement. Any such cases will be listed on the Registrar’s website and its records under the category: “Closed

Complaints – Resolved/Settled/Withdrawn.”

Red Hawk Construction has been a family run business in the State of Arizona for over 2 decades and has never had such a complaint or any complaint for that matter filed with the ROC or any governing agency.

The owner of Red Hawk (Robin Cullipher) had been diagnosed with stage 4 cancer and in the spring of 2023 right around the time of this incident. Rob was fully engaged in the business and its dealings for almost a year until late February 2024. Rob made an o er to pay a portion of the invoiced amount despite the inadequacies that have been stated in these documents. That o er was rejected, and our legal counsel was consulted. It wasn’t until several days after his passing that a collection agency was assigned to attempt to strong arm or force Red Hawk into paying for inadequate services rendered.

Kris has no record of what happened on site or any corroborating documentation other than an unsigned work order, invoice, and photos of the project post completion and of tools in his yard that he did not use on this project. They also conveniently left out all the correspondence and photos that contradict their claim. All Red Hawk photo documentation is time stamped, dated and geo tagged should there be any dispute as to location or validity.

We do not believe that this is appropriate. We request that this complaint is dismissed on the grounds that the contractor B-Line Construction did not perform the work as required and did not provide adequate equipment at the time of service, however, claim that they had the equipment to perform the work correctly nearly 18 months later. Kris with B-line acknowledged and confirms that they did not meet the requirements of the project in the first paragraph of the email sent 7/25/2024.

Doug,

We performed the boring as we quoted and as we had discussed with Rob Cullipher. We were to bore and ream the bore hole and Redhawk would dig a trench long enough for the welded pipe to lay in so it could be pushed into the bore hole. Yes, the bore did come out 24” lower than Rob wanted but this was due to conflicting AT & T major backbone fiber line being in our way and bore was started deeper than anticipated. The ground conditions were also a factor as it was caliche, and our rock drill was required, and the steering is minimal.

Rob did call me when completed and said the bore hole was 24” lower than he wanted. I came out to the site and reviewed and told Rob we could not rebore as if we tried to go higher it would just fall back into the old bore hole. I said the other option is to ream the hole to 48” and that would allow us to move the pipe up, but MCDOT would not like having that much extra bore space under road. I suggested that Rob contact water department and allow them to angle pipe up to existing water line. This is done all the time when trenching and the pipe needs to go up or down over existing utilities. Rob said he would and keep me updated if anything needed changing.

I had assumed all went well and Redhawk had finished the job as Rob did not contact us again about this. I just happened to call Dan Garrett (friend of Rob and does contracting work) about a UTV I had purchased from him, and Dan said guess where I’m at, on your bore job for Redhawk. I was very upset to hear this and immediately drove to the job site. I observed another bore company Boss II attempting to reopen our old bore hole with tires strapped to a small reamer which would never work. Dan said they did not own any bigger reamers. They also were using the wrong mud mix which was basically straight water which will never carry out bore cuttings. I stayed around for a little while and left upset as we always finish our jobs, we would have gladly come back out and rereamed the bore hole which would have only taken a couple of hours.

The reason the bore hole needed to be rereamed is they waited almost 2 weeks to install the steel casing. The casing needs to be installed the very next day or the bore hole will dry out and the pipe could never be installed, 2 weeks and the bore is almost completely dried out. Doug, you mentioned you could not see thru the bore hole, and yes you should never be able to see thru the bore hole as it is full of liquified ground. How the bore process is done, the hole is reamed with the proper mud mixture and cuttings are suspended in the mud mixture like a thick milk shake. When the casing is installed, the casing displaces

the liquid dirt out the ends of the bore hole and the mud surrounds the casing leaving no voids under the roadway after the mud dries.

Redhawk would not have encountered any extra cost if they would have just called us back, we would have rereamed the bore hole. We would have reamed it correctly and the pipe would have gone in easily. Boss II did not make a new bore hole (see attached photo) the casing was installed in the same bore hole we bored, and the water line was angled up to existing water as I had suggested to Rob. We own several large reamers (see attached)

We also never charged any extra for the changed scope of work (see attached quote). We quoted 40ft of boring and we bored 80’, we quoted dirt conditions, and it was caliche and required our rock drill to complete. I even reduced the quote from $9500 to $7500 just to be nice to Rob as I contributed the lapse of judgement on his recent finding of terminal cancer and figured his mind was preoccupied with more important things.

We did get a call from a lady that asked us to take $5000 for full payment and I said no as we had already reduced amount and never charged for the change orders.

We are confident that we are owed this money and will be happy to pursue this further.

Chris Stadeli, There is no legitimate reason for us to pay this Invoice. The work performed by B-Line did not meet the project specifications. The poor execution of the initial work, which we pointed out to your on-site personnel, was met with a refusal to take any corrective action and abandonment of the project on the part of B-Line, causing additional cost and warranty issues for Redhawk construction. B-line was notified of the failure to produce a satisfactory boring shaft both in form and location that would accommodate the specified sleeve at the proper plan elevation. B-line refused to correct the issue and abandoned the project. Even with these issues, Red Hawk offered to pay half of the amount B-Line invoiced as a good partnering gesture, was this was again met with a refusal to acknowledge any problem with B-Line’s work and opposition to any sort of compromise. Red Hawk’s offer to pay half the invoiced amount is withdrawn.

Please keep in mind that if you continue on your current path of attempting to collect the full invoiced amount even though B-Line’s work did not conform to the project specifications and had to be performed by a replacement contractor, Redhawk intends to enforce its rights to back charge for the following, incurred costs as the result of B-lines failure, including but not limited to: 1. All labor and equipment and overhead costs for re-drilling the existing hole to accept the required size pipe 2. All equipment, labor, parts and overhead associated with a vertical waterline realignment caused by the failure to install the directional bore at the proper elevation (Other contractors were unable to drill at the proper depth due to the location of the bore done by B-line, and the likelihood of collapse and catastrophic failure) 3. Additional Traffic control and associated safety costs in MCDOT ROW 4. Damage caused to Redhawk equipment while installing 80lf ½” steel sleeve on a radius

Below is a timeline of events, along a link to view our time, date and location stamped photos that document the work performed and the aforementioned deficiencies in B-Line’s work.

4/18 – Travis Wasden with B-line began drilling on site.

4/19 – Bore was punched thru. Photo taken of B-line employee in the hole with the bore head and confirming that the alignment was 24” low. 4/20 – B-line de-mobed. Photos were taken of finished product (No daylight was observed on the end due to curved radius of the bore) and the location/elevation deficiency of approximately 24”. 4/20 – B-line was contacted via phone call by Rob Cullipher (Owner of Redhawk) requesting that corrective action was taken to rectify the inadequacies. Rob was told that no additional effort was going to be made by B-line construction. 4/21 – 4/28 – Redhawk solicited other contractors to re-bore and correct the issues 5/1 – Third party contractor was hired to attempt to correct the issues. (Chris the owner of B-line) visited the site to observe third party contractor. 5/3 Sleeve was installed (Damage to CAT320 Excavator bucket due to curved bore) 5/4 Waterline was installed. 5/24 Vertical realignment (After approval from AZ water and ADEQ)

We have consulted with our attorney, and we are confident we owe nothing to B-Line for its deficient work which we were required to correct through a replacement contractor. If you continue to escalate this, then you will leave us with no option but to defend our position and hold B-Line liable for the deficiencies in its work and the additional costs we incurred as a result of it.

Factual Background In 2023, Complainant was hired by Respondent Red Hawk Construction, LLC (“Red Hawk”) to drill a horizontal boring shaft for the placement of a water line on the Better Choice Homes project in Mesa. Complainant did drill a hole, but the hole drilled by Complainant was 24 inches lower than required and did not meet the project specifications. One of Red Hawk’s other subcontractor’s, Badger Daylighting Corp., had exposed the utility lines before Respondent began its work. Respondent observed the exposed utilities and raised no concerns about any of them. Complainant later claimed that the location of one of those utility lines was the reason it had to deviate from the project specifications, but Complainant did not inform Red Hawk of its concerns nor did Received Legal 10/01/2024

it consult with Red Hawk about how its work would deviate from the contract requirements beforehand. When Red Hawk became aware of it after the fact, it notified Complainant that the work needed to be corrected. Complainant refused to take any corrective action. Red Hawk was required to hire a new boring contractor (Boss Drilling), who performed the work as specified. In an e-mail from Kris Stadeli (Complainant’s Qualifying Party) dated June 25, 2024, Mr. Stadeli admitted that the boring shaft was 24 inches lower than it should have been, and that Rob Cullipher of Red Hawk notified him of the problem. A copy of this e- mail is attached hereto as Exhibit A. 2. Response to Alleged Violations of Statutory Provisions Charge 1 of the Citation states, in relevant part: Charge 1: A.R.S. § 32-1154(A)(10) – Failure by a licensee or agent or official of a licensee to pay monies in excess of $750 when due for materials or services rendered in connection with the licensee’s operations as a contractor unless the licensee proves that the licensee lacks the capacity to pay and has not received sufficient monies as payment for the particular construction work project or operation for which the services or materials were rendered or purchased. (Emphasis Added). This statute is not violated simply because a licensed contractor fails to pay an invoice. Instead, a violation occurs only if a licensee fails to pay money that is actually due. Doug,

We performed the boring as we quoted and as we had discussed with Rob Cullipher. We were to bore and ream the bore hole and Redhawk would dig a trench long enough for the welded pipe to lay in so it could be pushed into the bore hole. Yes, the bore did come out 24” lower than Rob wanted but this was due to conflicting AT & T major backbone fiber line being in our way and bore was started deeper than anticipated. The ground conditions were also a factor as it was caliche, and our rock drill was required, and the steering is minimal.

Rob did call me when completed and said the bore hole was 24” lower than he wanted. I came out to the site and reviewed and told Rob we could not rebore as if we tried to go higher it would just fall back into the old bore hole. I said the other option is to ream the hole to 48” and that would allow us to move the pipe up, but MCDOT would not like having that much extra bore space under road. I suggested that Rob contact water department and allow them to angle pipe up to existing water line. This is done all the time when trenching and the pipe needs to go up or down over existing utilities. Rob said he would and keep me updated if anything needed changing.

I had assumed all went well and Redhawk had finished the job as Rob did not contact us again about this. I just happened to call Dan Garrett (friend of Rob and does contracting work) about a UTV I had purchased from him, and Dan said guess where I’m at, on your bore job for Redhawk. I was very upset to hear this and immediately drove to the job site. I observed another bore company Boss II attempting to reopen our old bore hole with tires strapped to a small reamer which would never work. Dan said they did not own any bigger reamers. They also were using the wrong mud mix which was basically straight water which will never carry out bore cuttings. I stayed around for a little while and left upset as we always finish our jobs, we would have gladly come back out and rereamed the bore hole which would have only taken a couple of hours.

The reason the bore hole needed to be rereamed is they waited almost 2 weeks to install the steel casing. The casing needs to be installed the very next day or the bore hole will dry out and the pipe could never be installed, 2 weeks and the bore is almost completely dried out. Doug, you mentioned you could not see thru the bore hole, and yes you should never be able to see thru the bore hole as it is full of liquified ground. How the bore process is done, the hole is reamed with the proper mud mixture and cuttings are suspended in the mud mixture like a thick milk shake. When the casing is installed, the casing displaces

the liquid dirt out the ends of the bore hole and the mud surrounds the casing leaving no voids under the roadway after the mud dries.

Redhawk would not have encountered any extra cost if they would have just called us back, we would have rereamed the bore hole. We would have reamed it correctly and the pipe would have gone in easily. Boss II did not make a new bore hole (see attached photo) the casing was installed in the same bore hole we bored, and the water line was angled up to existing water as I had suggested to Rob. We own several large reamers (see attached)

We also never charged any extra for the changed scope of work (see attached quote). We quoted 40ft of boring and we bored 80’, we quoted dirt conditions, and it was caliche and required our rock drill to complete. I even reduced the quote from $9500 to $7500 just to be nice to Rob as I contributed the lapse of judgement on his recent finding of terminal cancer and figured his mind was preoccupied with more important things.

We did get a call from a lady that asked us to take $5000 for full payment and I said no as we had already reduced amount and never charged for the change orders.

We are confident that we are owed this money and will be happy to pursue this further.

Kris, It was conveyed to B-line that Red Hawk would pay a portion and that offer was refused. The result of that refusal was Rob was clear that Red Hawk would not be paying this invoice. Chris Stadeli, There is no legitimate reason for us to pay this Invoice. The work performed by B-Line did not meet the project specifications. The poor execution of the initial work, which we pointed out to your on-site personnel, was met with a refusal to take any corrective action and abandonment of the project on the part of B-Line, causing additional cost and warranty issues for Redhawk construction. B-line was notified of the failure to produce a satisfactory boring shaft both in form and location that would accommodate the specified sleeve at the proper plan elevation. B-line refused to correct the issue and abandoned the project. Even with these issues, Red Hawk offered to pay half of the amount B-Line invoiced as a good partnering gesture, was this was again met with a refusal to acknowledge any problem with B-Line’s work and opposition to any sort of compromise. Red Hawk’s offer to pay half the invoiced amount is withdrawn.

Please keep in mind that if you continue on your current path of attempting to collect the full invoiced amount even though B-Line’s work did not conform to the project specifications and had to be performed by a replacement contractor, Redhawk intends to enforce its rights to back charge for the following, incurred costs as the result of B-lines failure, including but not limited to: 1. All labor and equipment and overhead costs for re-drilling the existing hole to accept the required size pipe 2. All equipment, labor, parts and overhead associated with a vertical waterline realignment caused by the failure to install the directional bore at the proper elevation (Other contractors were unable to drill at the proper depth due to the location of the bore done by B-line, and the likelihood of collapse and catastrophic failure) 3. Additional Traffic control and associated safety costs in MCDOT ROW 4. Damage caused to Redhawk equipment while installing 80lf ½” steel sleeve on a radius

Below is a timeline of events, along a link to view our time, date and location stamped photos that document the work performed and the aforementioned deficiencies in B-Line’s work.

4/18 – Travis Wasden with B-line began drilling on site.

4/19 – Bore was punched thru. Photo taken of B-line employee in the hole with the bore head and confirming that the alignment was 24” low. 4/20 – B-line de-mobed. Photos were taken of finished product (No daylight was observed on the end due to curved radius of the bore) and the location/elevation deficiency of approximately 24”. 4/20 – B-line was contacted via phone call by Rob Cullipher (Owner of Redhawk) requesting that corrective action was taken to rectify the inadequacies. Rob was told that no additional effort was going to be made by B-line construction. 4/21 – 4/28 – Redhawk solicited other contractors to re-bore and correct the issues 5/1 – Third party contractor was hired to attempt to correct the issues. (Chris the owner of B-line) visited the site to observe third party contractor. 5/3 Sleeve was installed (Damage to CAT320 Excavator bucket due to curved bore) 5/4 Waterline was installed. 5/24 Vertical realignment (After approval from AZ water and ADEQ)

We have consulted with our attorney, and we are confident we owe nothing to B-Line for its deficient work which we were required to correct through a replacement contractor. If you continue to escalate this, then you will leave us with no option but to defend our position and hold B-Line liable for the deficiencies in its work and the additional costs we incurred as a result of it.

Mediation is a method of resolving disputes where the parties can end conflict without the expense and time associated with the full administrative process.
