Respondent’s March 25, 2025, Motion to Continue is denied. The matter remains scheduled for continued hearing on April 03, 2025, at 9:00 a.m.
Additionally, the Tribunal declines to decide, rule, or respond to further submissions from either party amounting to mere petty squabbles. If the parties wish to participate in alternative dispute resolution, to address their issues in whole or in part, they are free to do so. The undersigned cannot serve as both Mediator and ALJ.
Furthermore, although the current proceedings are inherently adversarial in nature, each party is presumed to engage in good faith and fair dealing; particularly when complying with subpoenas issued by the undersigned pursuant to Ariz. Admin. Code R2-19-115(D). Any party deemed to have intentionally engaged in unbecoming conduct will be a factor in aggravation in the resulting Recommended ALJ Decision issued to the Director of the Arizona Registrar of Contractors in the above-captioned matter.
