ORDER RE: OBJECTION TO SUBPOENAS AND MOTION TO QUASH

AND ORDER SUMMARIZING JANUARY 21, 2025 PREHEARING

CONFERENCE

On January 21, 2025, at 10:30 a.m., a telephonic pre-hearing conference was held. Zachary W. Rosenberg, Esq. and Mario C. Vasta, Esq. represented Complainant Jaime S. Mayol. Kevin M. Estevez, Esq. and Tyler S. Woods, Esq. represented Respondent Southern Arizona Structures, LLC. Several subjects were discussed as follows:

Complainant’s Objection to Subpoenas and Motion to Quash and Respondent’s response thereto:

After discussion, the parties requested that the Administrative Law Judge hold off for one week before issuing an Order regarding these motions as the parties believed they could come to an agreement regarding the exchange of information requested in the subpoenas. Respondent’s counsel further indicated that if Complainant provided the documents sought there would be no need to subpoena the financial institution. To date, the parties have not filed any communication with the Tribunal as to this issue.

Therefore,

Upon review and consideration,

IT IS ORDERED QUASHING the subpoena issued to Choice Financial Group dba Choice Home Loans.

IT IS FURTHER ORDERED DENYING the Motion to Quash the subpoena issued to Complainant. However, Complainant may redact personal information from the documents to be produced.

Possible continuance request:

The parties further discussed that one of them may be requesting a continuance of the six-day hearing that is set to begin March 17, 2025. The Administrative Law Judge explained to the parties that a continuance of a six-day hearing would result in a hearing setting sometime in June or July, 2025, however, could potentially be sooner if they do not believe they need six full days. The parties indicated they would advise the Tribunal of a requested continuance within one week. The parties have not filed any updates with the Tribunal.

Length of hearing:

The parties indicated that they may be able to stipulate to certain facts, resulting in a reduction of hearing days and would advise the Tribunal of such within one week. The parties have not filed any updates with the Tribunal.
