ORDER GRANTING CONTINUANCE

AND SETTING STATUS DATE

Pending before the Office of Administrative Hearings is Respondent’s Motion to Stay, Complainant’s Response in opposition thereto, and Respondent’s Reply in support of its Motion to Stay. Upon review and consideration of the filings, given the legal issues raised, and in the interest of administrative efficiency, the Tribunal has concluded that the issue of the determination of which contract is controlling in this matter should be determined by the Superior Court prior to the matter proceeding to hearing before the Office of Administrative Hearings.

As the Office of Administrative Hearings does not have a procedure to implement a stay, the alternative is to set this matter for a written Status Update in six months.

Therefore,

Good cause appearing, the hearing in the above-entitled matter is continued and set for a written Status Update on October 6, 2025. On or before this date, the parties are advised to do one of the following:

Inform the Tribunal that the parties need additional time for the Superior Court to issue a ruling by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

Inform the Tribunal that the Superior Court has issued its ruling regarding the controlling contract and advise how the parties wish to proceed.

IT IS ORDERED VACATING the pending hearing dates.
