If you have requested to appear in-person at the hearing, the hearing will be held at 1740 W Adams Street, Phoenix, AZ 85007.
You must attend this hearing. This is an adversarial hearing before an administrative law judge, and is conducted in a similar manner as judicial proceedings. Thus, you must be
prepared to present evidence, including witness testimony and documents, in support of your case.
STATEMENT OF LEGAL AUTHORITY AND JURISDICTION
The State of Arizona has determined that the licensing and regulation of construction contractors is a proper state function, and has vested authority in the Registrar of Contractors to administer Title 32, Chapter 10 of the Arizona Revised Statutes. A.R.S. §§ 32-1101 et seq. All hearings for alleged violations of Title 32, Chapter 10 are conducted under Title 41,
Chapter 6, Article 10. A.R.S. § 32-1156.

The statutes and rules the Respondent is alleged to have violated are cited in the
complaint and citation, which were served on the Respondent on June 11, 2024. SHORT AND PLAIN STATEMENT OF THE MATTERS ASSERTED
The complaint and citation allege that the Respondent committed the following act(s): Charge: 1 A.R.S. § 32-1154 (A)(10)
THE PARTIES TO THE ADMINISTRATIVE HEARING Because Respondent is a licensee and is charged with an act(s) or omission(s) that is cause for the suspension or revocation of a license, Respondent is a party to this case and will be a party to the hearing. Because Complainant alleged Respondent committed an act(s) or omission(s) that is cause for the suspension or revocation of a license, Complainant is a party to this case and will
be a party to the hearing.
Respondent and Complainant, as the parties to the hearing, will present evidence and
argument to the administrative law judge.
RIGHT TO BE REPRESENTED The parties to the administrative hearing may choose to be represented by an attorney. A.R.S. § 41-1092.07(B). If one of the parties is a company, the company may be represented
by an officer or employee if that person satisfies the conditions set forth in A.R.S. § 32-
1156(B).
CHANGE OF ADDRESS Each party must inform the Registrar and the Office of Administrative Hearings of any change of address within five (5) days of the change. A.R.S. § 41-1092.04.
HEARING PROCEDURES AND RULES
The administrative hearing will be conducted in accordance with A.R.S. §§ 41-1092 to -1092.12, and A.A.C. R2-19-101 to -122. The parties should review the statutes, rules, and
processes governing the administrative hearing. Copies of the statutes, rules, and articles regarding the administrative hearing process can be found at https://www.azoah.com/.
REGISTRAR’S APPEARANCE BY VIDEO CONFERENCE OR TELEPHONE
The Registrar’s investigators, employees, and attorneys will appear at the hearing via
video conference or telephone unless requested by a party to appear in-person. Requests for the Registrar’s investigators, employees, or attorneys to appear in-person must be filed with the Registrar and the Office of Administrative Hearings no later than seven (7) calendar days prior to the hearing date.
HEARING PACKET
In the interests of administrative efficiency, the Registrar compiles and discloses
certain documents to the parties and the Office of Administrative Hearings. These documents
are attached to this Notice of Hearing as the “Hearing Packet.” If any party wishes to submit additional evidence, they must do so during the hearing after completing a disclosure statement. See “Disclosure Statement” section below.
SUBPOENAS FOR TESTIMONY FROM A WITNESS OR DOCUMENTS
The parties to the hearing must be prepared to present evidence in support of their
case. If a party wants to obtain testimony from a witness or documents not in the party’s
possession, the party must prepare and file a written subpoena for the Administrative Law
Judge to review and sign, if approved. A.R.S. § 41-1092.07(C). Forms for requesting a subpoena can be found on the Office of Administrative Hearings’ website at www.azoah.com.
The party seeking a subpoena must serve notice on all the parties to the hearing, and on the Registrar. A.R.S. § 41-1092.04.
DISCLOSURE STATEMENT
At least seven calendar days before the hearing, each party must prepare and serve a
disclosure statement on all other parties, and file it with the Office of Administrative Hearings. A.A.C. R4-9-118; A.A.C. R2-19-108. The disclosure statement must include any exhibit the party will use at the hearing. A party’s failure to timely disclose any witness or exhibit, without good cause, may result in the administrative law judge excluding those witnesses or exhibits from being used at the hearing. CHANGING THE HEARING DATE
The date of the hearing may only be advanced or delayed on the agreement of the
parties or on a showing of good cause. A.R.S. § 41-1092.05(C). The date of the hearing may
be changed by filing a written agreement of the parties to change the date of the hearing. The
written agreement must be filed with the Office of Administrative Hearings, directed to the assigned Administrative Law Judge, and transmitted to the Registrar and all other parties. The assigned Administrative Law Judge may be found on the Office of Administrative Hearings’ web portal at www.azoah.com
If a party would like to move the date of the hearing without agreement of all parties, the party must file a written motion with the Office of Administrative Hearings, directed to the assigned Administrative Law Judge, and transmit a copy to the Registrar and all other parties. The motion must state in detail good cause for why the date of the hearing should be advanced or delayed, and the position of all other parties regarding the advancement or delay. A party may also file a motion asserting a right to an expedited hearing upon a showing of
extraordinary circumstances or the possibility of irreparable harm. A.R.S. § 41-1092.05(E).
RESOLUTION SHORT OF ADJUDICATION In any case which is resolved or settled by the parties, or which is withdrawn by the Complainant without objection from Respondent after the Notice of Hearing is issued, the parties must notify the Office of Administrative Hearings of the resolution or settlement. Any such cases will be listed on the Registrar’s website and its records under the category: “Closed
Complaints – Resolved/Settled/Withdrawn.”

Dear Complainant and Respondent: The Registrar received a complaint filed against Carlina Home Remodeling LLC for non- payment of materials or services rendered. This complaint is incomplete and will not be substantively reviewed by the Registrar until the following documentation is provided:

I just received the complaint dated May 22, 2024, via US mail. I did not receive any email with the complaint attached. Here is my response;
I hired Upright Concrete to pour concrete including footers and a new garage floor. I supplied them with City of Scottsdale stamped plans to work from. The plans clearly state that work to be performed according to Scottsdale building codes. Scottsdale Building code calls for garage floors to be poured with a slope so water drains away from the house. As a licensed concrete contractor Upright should have know this.
Upright Concrete poured the garage floor flat, without slope. In fact it pooled in the center and drained back into the house at the back portion of the floor. Upright concrete claims the plans did not address slope, so they poured flat. I called the Scottsdale plan reviewer, she said she did not call out the om mission of a slope because very few plans show a slope on the garage floor. She further stated that concrete companies should know to pour with slope. I also reached out to other concrete companies and all of them told me they know to pour with slope in Scottsdale.
I reached out to Upright concrete and told him the problem. He told me he always pours garages flat and there is nothing to fix. So I found another Concrete contractor (Precision Concrete Repair ROC#328466 CR-9). They determined the garage floor was defective and gave me a letter describing the problem (attached). I hired them to correct the problem. The cost for this was $10,826.40, which I have paid in full.
During framing, we found out that Upright Concrete did not pour the garage pad square. The northwest corner is 101/2" shorter than the southwest corner. We had to pour new footers along the entire west side to make square. I attached photos of the new work along with a letter from my Foreman describing the issue. I hired Precision Concrete Repair to pour the new footers. This cost me $4,900.
The total for these two repairs was $15,726.40. I subtracted this amount from the $20,000 final invoice from Upright Concrete and issued them a check on 5/23/2024 in the amount of $4,273.60. In my calculations I did not charge Upright for additional costs I incurred with my Foreman and Project manager trying to come up with a solution. LEGAL RECEIVED 06/10/2024

Hello,
This letter is in regards to a concrete pour you did at the above referenced property.
As we have discussed in several previous discussions, you poured the garage without a slope, as required by Scottsdale City code. When we hired a company to correct the problem, they determined there was actually a slope going down into the house. The company that corrected the problem submitted an explanation describing this. I have attached their email. I have also attached their invoices that I paid for the correction.
Once we began the framing, we found another mistake you made on the garage pad pour. The northwest corner is 1O ½" shorter than the southwest corner. We had to pour new footers along the entire west side of the pad to make it square. Also, on the new living area the pad pour is 5" out of square, which will need to be corrected. I have attached an email from my Construction Foreman describing these mistakes, and pictures showing the new footers we had to pour. I have also attached the paid invoice from the company we hired to make these corrections.
These two invoices total $15,726.40. I am subtracting this amount from your invoice #35, dated 4/8/2024. I have enclosed a check in the amount of $4,273.60 for final payment on this invoice.

Sorry for the delay.
Regarding the garage floor at Vista Bonita, our team had to take down the concrete floor by a total of 1 3/4" to provide the correction needed to meet the appropriate slope.
Prior to our work, the slope was going down into the house instead of going out as it normally should.

Good afternoon,
On the concrete at Vista Bonita the new 3 car garage pad was not poured square. The northwest corner is 10 1/2" shorter than the southwest corner. We will need to pour new footers along the entire west side of the pad to make it square. This will incur a cost of $4,900 to tie into the current pad. Picture of new footing attached.
The concrete pad behind the three car garage referenced as the "Game Room" is also out of square and needed the southwest corner to be cut back 4" to match the northwest corner.
Also, on the new Living Area pad the pour is 5" out of square. The northeast side is over the line with the southeast side. This will need to be cut down to make square. Thank you,

I just received the complaint dated May 22, 2024, via US mail. I did not receive any email with the complaint attached. Here is my response;
I hired Upright Concrete to pour concrete including footers and a new garage floor. I supplied them with City of Scottsdale stamped plans to work from. The plans clearly state that work to be performed according to Scottsdale building codes. Scottsdale Building code calls for garage floors to be poured with a slope so water drains away from the house. As a licensed concrete contractor Upright should have know this.
Upright Concrete poured the garage floor flat, without slope. In fact it pooled in the center and drained back into the house at the back portion of the floor. Upright concrete claims the plans did not address slope, so they poured flat. I called the Scottsdale plan reviewer, she said she did not call out the om mission of a slope because very few plans show a slope on the garage floor. She further stated that concrete companies should know to pour with slope. I also reached out to other concrete companies and all of them told me they know to pour with slope in Scottsdale.
I reached out to Upright concrete and told him the problem. He told me he always pours garages flat and there is nothing to fix. So I found another Concrete contractor (Precision Concrete Repair ROC#328466 CR-9). They determined the garage floor was defective and gave me a letter describing the problem (attached). I hired them to correct the problem. The cost for this was $10,826.40, which I have paid in full.
During framing, we found out that Upright Concrete did not pour the garage pad square. The northwest corner is 101/2" shorter than the southwest corner. We had to pour new footers along the entire west side to make square. I attached photos of the new work along with a letter from my Foreman describing the issue. I hired Precision Concrete Repair to pour the new footers. This cost me $4,900.
The total for these two repairs was $15,726.40. I subtracted this amount from the $20,000 final invoice from Upright Concrete and issued them a check on 5/23/2024 in the amount of $4,273.60. In my calculations I did not charge Upright for additional costs I incurred with my Foreman and Project manager trying to come up with a solution. LEGAL RECEIVED 06/10/2024

Regarding the garage floor at Vista Bonita, our team had to take down the concrete floor by a total of 1 3/4" to provide the correction needed to meet the appropriate slope.
Prior to our work, the slope was going down into the house instead of going out as it normally should.

Respondent Carlina Home Remodeling LLC (“Carlina”) hereby responds to the Citation and Complaint issued by the Registrar of Contractors (“ROC”) based on the No- Pay Complaint filed by Complainant Upright Concrete, LLC (“Upright”). 1. DENIAL OF CHARGES AND ALLEGATIONS Carlina denies all charges and allegations of the Citation and Complaint in their entirety. Carlina did not fail to pay Upright monies “when due” under A.R.S. § 32- 1154(A)(10). Upright has been in breach of its duty to perform proper and conforming workmanship by, among things, its failure to perform its work pursuant to applicable

workmanship and industry standards including the City of Scottsdale’s Building Code and its failure to correct such defective work upon notice. Carlina has remitted final payment for the amount due to Upright of $4,273.60 which Upright has accepted. That amount is a reduction of the $20,000 claimed by Upright after application of the total costs incurred by Carlina of $15,726.40 to correct
Upright’s work after Upright refused to do so (the “Back Charge”). A true and correct
copy of the Back Charge letter with the enclosed check for final payment is attached as
Exhibit 1. Carlina had no choice but correct Upright’s work in order to comply with
Scottsdale’s Building Code, so as to pass inspection and otherwise satisfy Carlina’s
contract with the homeowner.
Carlina hereby incorporates by this reference as though fully set forth herein its
Response to the Complaint on which the Citation is based including all attachments to
the Response filed on June 10, 2024. Carlina summarizes the two main issues underlying
it satisfaction of final payment and the Back Charge to substantiate this Answer. A. Code Failure Upright was hired to pour a new garage floor with footers for the Smock Residence project for a total $40,000 (50% to be paid up front and 50% to be paid upon completion). A true and correct copy of Upright Invoice #35 is attached as Exhibit 2. The plans governing Upright’s work stated that all work must conform to the City of Scottsdale’s Building Code (which here is The International Residential Code for One- and Two- Family Dwellings, adopted by the City in Scottsdale Revised Code Section 31-31(2)). From an industry standard, a concrete contractor performing work in Scottsdale should know that any concrete work to pour a new garage floor must comply with the City’s Code by sloping the floor away from the interior of the residential structure and otherwise should know that doing so is proper workmanship. Carlina determined that Upright’s concrete work did not conform to the Code

requirement or the industry standard, in that the garage floor sloped toward the interior of the structure and that certain areas of the garage floor were not level. Carlina advised Upright. Upright refuted the Code requirement and any such workmanship standard, and thus failed and refused to correct its work. Ultimately, Upright demanded full payment of the balance of its invoice, refuted
the workmanship requirements and its failure to conform to them, and did not correct its
work. Carlina was forced to pay a replacement contractor, Precision Concrete Repair, in
the amount of $10,826.40 to bring the garage floor to Code. True and correct copies of
the email from Precision Concrete’s Zaq Sala describing the corrective work and
Precision’s invoices are attached as Exhibit 3.
B. Defective Footers
Upon beginning the framing for the structure, Carlina discovered that the
footers dug by Upright were not square. This defect existed despite the fact that Carlina
had staked the areas. Carlina was forced to engage its replacement contractor, Precision, to correct the footings for a total cost of $4,900. A true and correct email describing the defect from Carlina’s project manager, Todd Elkin, and the invoice from Precision that Carlina paid to correct the footings are attached as Exhibit 4. Carlina also attaches true and correct copies of the photographs it took contemporaneously with its inspection of the foregoing defective work as Exhibit 5. 2. REQUEST FOR INFORMAL SETTLEMENT CONFERENCE Carlina requests a settlement conference in accordance with A.R.S. § 41-1092.06. RELIEF REQUESTED For the reasons set forth above, Respondent Carlina denies the Citation and Complaint in its entirety, and requests that this matter be dismissed due to (1) Carlina’s final payment to Upright for the full amount due on the subject project, which Upright has accepted; and (2) the damages that Carlina has incurred as a direct and proximate

Attached is an email sent to Carl,owner. Upright Concrete offered to fix the issue and was denied by Carlina Home Remodeling we stated that we poured concrete following the plans and in the plans it did not show a slope . We never refused to fix anything. The footer situation was never brought to my attention untill we received this last check with the letter of explanation. We would definitely have fixed this situation if Carl had allowed us to.
