The undersigned Administrative Law Judge, having reviewed the document Motion to Dismiss as submitted by Respondent December 03, 2024, issues the following:
Respondent’s motion is denied. Respondent’s primary argument, regarding an alleged “lack of sufficient evidence” on behalf of Complainant is not grounds for dismissal. If anything, it concedes the point that an actual case or controversy exists between the parties, under the Arizona Registrar’s jurisdiction and control. At the close of Complainant’s Case-in-Chief Respondent may, at its own discretion, submit a Motion for Summary Judgment if Respondent is of the opinion that the part with the burden of proof has failed, in any material way, to sustain said burden by a preponderance of the evidence.
