Purpose of the Jobsite Inspection When the Registrar receives a complaint against a contractor’s license alleging poor workmanship, the Registrar generally schedules a Jobsite Inspection. The Jobsite Inspection serves two purposes: 1. To give the contractor an opportunity to inspect the complaint items; and 2. To give the Registrar an opportunity to determine if the contractor’s work violates Arizona law.

Jobsite Inspection Rights and Responsibilities Access to inspect: The property owner has complete control over who they allow on the property. However, if the Registrar’s investigator or the contractor cannot inspect the work, the Registrar will not move forward with a citation.

Cooperation: Arizona law enables injured parties to seek relief for damages through several paths. When dealing with a licensed contractor, the Registrar of Contractors’ administrative complaint process may serve as one of those possible paths. However, in order to use that path, the Registrar relies on the cooperation of all parties to a complaint.

Minimum workmanship: The Registrar investigates workmanship complaints for compliance with minimum workmanship and professional industry standards. The Registrar does not issue citations for work that meets these standards.

Scope: The scope of the Jobsite Inspection is limited to items listed in the complaint filed with the Registrar’s office. It is the complainant’s responsibility to point out the complaint item(s) and the Investigators role to review the item(s). If the complainant identifies additional workmanship items not listed in the original complaint, they must file an addendum to the complaint. The Registrar’s Investigator may identify additional administrative violations by the contractor (e.g. work performed out of scope of the license and failure to provide a contract that meets requirements set by Arizona law) at the time of the inspection.

The Role of the Investigator At the Jobsite Inspection, the Registrar’s investigator will: ● Only investigate the items listed on the complaint form filed with the Registrar. ● Will gather evidence to make an informed decision about the complaint items.

What to expect after a Jobsite Inspection After doing a Jobsite Inspection, the Registrar’s Investigator will leave the jobsite and review the evidence provided during the inspection. Generally, the investigator does not make any determination at the time of the jobsite inspection regarding whether the allegations listed in the complaint are supported. ● If the allegations are confirmed, the Registrar’s Investigator may issue a Written Directive telling the contractor to correct the poor or incomplete work. ● If the allegations are not confirmed, the Registrar’s Investigator will close the complaint.

Questions? If you have already filed a complaint and it was assigned to an investigator, you are encouraged to contact that investigator directly with the information listed in your jobsite inspection letter. If you have not filed a complaint yet or have not been assigned an investigator, you can reach the Registrar’s compliance department at (877) 692-9762. 1700 W. Washington Street, Suite 105 · Phoenix AZ 85007-2812 602.542.1525 · Toll Free 877.692.9762 · roc.az.gov C008 12/23 A Guide to Written Directives Purpose of the Jobsite Inspection When the Registrar receives a complaint against a contractor’s license, the Registrar generally schedules a Jobsite Inspection. The Jobsite Inspection serves two purposes: 1. To give the contractor an opportunity to inspect the complaint items; and 2. To give the Registrar an opportunity to determine if the contractor’s work violates Arizona law.

Written Directives Access: In order to use the administrative process offered by the Registrar, a property owner must provide reasonable access to allow the contractor to fix their work as directed by the Registrar in a Written Directive. Complainants may not put any additional, unnecessary restrictions on the Respondent above and beyond the initial contract requirements agreed upon at the beginning of the project. Respondents are required to make repairs on items identified on any Written Directive, not otherwise restricted by local code or HOA limitations. Complainants must make access available to the Respondent to make the required repairs and failure to provide reasonable access may result in the Registrar dismissing the complaint.

Contractor obligations: The Written Directive will set a deadline for compliance. This is the period of time determined by the Investigator as necessary to complete the items listed in the Directive. ● The deadline for compliance assumes the contractor will promptly begin working on the items listed in the Directive. ● Do not wait. Both parties should communicate quickly to schedule the work.

Extensions: If good cause exists to extend this deadline, either party may submit a written request to the Investigator. The Registrar will review requests for extension and determine if the Directive should be extended.

Manner and method of performance: The Registrar does not provide specific instructions for how to correct poor work. A licensed contractor is expected to have the skill and professionalism to complete the work. Moreover, the complainant may not dictate the manner of repair. If the contractor fails to appropriately correct the work according to the contract, the Registrar will issue a citation.

Compliance Inspection: After the Written Directive expires, the Registrar’s Investigator will contact the complainant to determine if the contractor performed any corrective work. ● If the contractor did corrective work, the Investigator may schedule a Compliance Inspection to determine if the poor work is corrected. ● If the contractor did not perform any corrective work, the Registrar’s Investigator will not do a Compliance Inspection and will determine whether to issue a citation based on the administrative record.

Work performed after the directive ends: After the Directive period ends, a property owner may choose to allow the contractor to continue its work. The Registrar encourages parties to work cooperatively, but cannot 1700 W. A building permit was obtained by N/A List and briefly describe each complaint item (Please do not write "see attached" or use additional pages unless necessary to further describe issues or list more complaint items) (limited to 100 characters per line)

This remodel started on February 29th. I was told it would take 2-3 weeks. Every single thing done has been done illegally or with unacceptable workmanship. I provided the tile materials for the shower. Not my fault their shower guy botched the job causing the entire shower to be demolished down to studs. They need to rebuy it all now. Allegations Listed on Complaint:

Miguel, a non-licensed electrician performed electrical work throughout my home for Five Start Remodeling & Demo.

Miguel the electrician installed 15 lights, several switches, GFI outlets, fan outlets, thermostat, breaker

Miguel the electrician made several major holes/cuts in garage, connected GFI to wall switch.

Miguel the electrician in attic many times, insulation fell from vent in master bath, damage in attic?

Miguel the electrician installed a 90 degree wall edge installed in error. His fix left a rounded edge misaligned

George Tranca recommended pocket door to go in wall. I bought door. ROC plans to install in sheer wall, no engineering

Nonprofessional removed floor tiles to be replaced causing excessively unacceptable breakage. causing more tile damage

Surrounding tiles left now have chips, installed tile by non professional with reckless regard of limited tile qty

Tile cut jagged, inconsistent spacing, chipped tile install w/out baseboard. Doesn't have tile cutter for rounded edges

Drywall texture added on walls w/out sanding down, raised 3D texture, then scraped texture flat in attempt to fix

Handicap shower/tile installed w/poor workmanship causing redo portions 2 and 3 times AFTER I raised issues

Shower install so bad, Alex had shower install demolished. Spicket, valve, drain still misaligned at 2x4 stage now.

RCC099 12/05/18 Page 2 of 3 Licensed Complaint Form Departmental Use Only For Current or Suspended Licensees

x 4 studs sliced in several places & were covered up w/1st shower install where ADA grab bars are to go in shower

Both shower foundation removal, plumbing, shower install by non licensed worker, without any oversight by Company

Paid all but $750 left per contract. Remodel not half way complete & workmanship below standards on everything!

Just learned permits ARE required. Alex lied at quote & at start saying not needed. I have demanded permits.

Alex says he submitted request & no plans were needed despite wall demolition, plumbing, electrical, etc.

Maricopa Cty Inspector came over, said plans ARE required on demolition, electrical, plumbing - Alex lying again.

Door bell opposite of rewired switches & AC thermostat by Miguel is now short circuiting, ringing sporadically

Mentioned to Alex who heard door bell ring sporadically when he was here, but no action, ignored concern.

Complete disregard protect items prior to cement/drywall/tile dust has ruined box springs, drapes, bedding

Workers put up plastic using 3M Duck tape on ceiling wall has peeled paint off ceiling outside of remodel.

Company has reckless disregard for license responsibilities resulting in nightmare of botched work & huge delays

Alex has aided and abetted non licensed individuals to illegally do work in my home. Bath & room is uninhabitable.

Alex does NOT know code or building requirements for licenses, & has no electrical license!

ALL poor workmanship items are/were raised by me! Alex did not inspect work in progress/completion, I've had to do it.

RCC099 12/05/18 Page 3 of 3 The attached proposal I submitted is the contract Alex Tranca gave me. Alex called it the contract and I signed it while we were parked at my bank (Aero Federal Credit Union) in his truck. I am also providing print screens of the bank withdrawls from my credit union app for both payments made to Five Star Remodeling & Demo.

50% deposit of $6,750 paid on 2.29.2024

I told Alex I did not feel comfortable dealing with large amounts of cash and that he could either meet me at my bank or come to my house and we can go together for the 50% deposit payment at start of $6,750. Alex came to my house on the day of the remodel start and drove us to my bank where the teller counted out the 50% deposit payment of $6,750 to Alex who physically took the cash from the counter.

Invoice #352: Progress payments, electrical and tile floor install paid on 3.19.2024. Note, payment was made directly to Geo Tranca at my bank on 3.19.2024, NOT on 3.25.2024.

Alex told me that I owed progress payments of $4000 and $2000 per the contract, the electrical work done in my home and garage, and the tile in the remodel area. Note: I had asked Geo Tranca (Alex’s Dad) if the electrician was a licensed electrician in front of Miguel who claimed to be the electrician. Both Geo and Miguel adamantly answered, yes, yes! Thus, I in good faith, thought I was paying for electrical work done by a licensed electrician of $3070. The floor was almost done and I was told just grouting was left. So I, in good faith agreed to pay the agreed upon amount of $800 for the tile floor. I had not been going into the remodel area due to the massive amount of fiberglass, cement, tile, and drywall dust that had not been removed. This dust was allowed to blow into the rest of home that had activated my asthma causing me to take my asthma inhaler multiple times a day. I had no idea the tile floor was so botched with such poor workmanship and poor tile equipment at the time of payment.

Thus $9,870:

4000 – Progress payment

2000 – Progress payment

3070 – Electrical work done by non licensed electrician billed by Five Star Remodeling & Demo

800 – Tile installed in remodel area, not complete with discovered messed up tiles and botched install.

Last minute, Alex told me he was stuck across town at another job and that his father, George Tranca (aka Geo) who is also on the license for Five Start Remodeling and Demo was going to meet me at my bank to collect payment for Invoice# 352. Geo met me at my bank and I withdrew the full payment of $9,870. The teller counted out all the money in front of Geo and offered to put the money in a couple of envelopes. Geo declined and instead picked up the money from the counter and folded it into a big mound of cash and put it in his jean pocket.

Total payments made to Five Star Remodeling &Demo = $16,620 7/25/24, 8:08 AM State of Arizona Mail - Case 2024-04297

Case 2024-04297 message

Apolo Tranca <[email redacted]> Wed, Jul 24, 2024 at 10:53 PM To: [email redacted]

Hello, my name is Apolo Tranca, the owner of Five Star Remodeling and Demo. I am submitting a written response for Case 2024-04297. I want to acknowledge that I am fully aware about the case and the project's situation, and I remain committed to cooperating with all parties involved to complete the project. Following a complaint filed by my client, Rebecca Juarez, with the ROC, the inspector, Rebecca, and I met at her residence. Subsequently, the inspector issued a directive, but I was unable to proceed with any work as the plans from Maricopa County had not been filed. Although plans and permits were not initially part of the contract, I decided to cover the costs to satisfy the homeowner.

In the meantime, my mother fell seriously ill after the plans were approved. She was diagnosed with encephalitis, and we were unaware of the symptoms. This unforeseen family emergency took precedence over business matters for me.

I want to emphasize that I am not seeking sympathy or pity. However, when family issues arise, business becomes a secondary concern for me. I am still committed to completing the project and resolving matters with the customer. I will reach out to her to address this as soon as possible. She is also aware that all the necessary materials, such as tile, schluters, and plans, have already been purchased, and I can provide proof of this.

Thank you,

Apolo.
