ORDER GRANTING CONTINUANCE

AND SETTING STATUS DATE

The hearing of this matter was scheduled to convene on September 23, 2024, at 1:00 p.m. On the date and time set for hearing, Megan Schandle, Esq. represented Complainant Noel Schneider who was present with her husband, Scott Schneider. Julianne Wheeler, Esq. represented Respondent Quest Pool Company, LLC. Mike Stocker was present on behalf of Respondent Quest Pool Company, LLC. Arizona Registrar of Contractors Investigator Albert Bernal was present.

Prior to going on the record, the parties’ respective counsel advised the Tribunal that they were in the process of negotiating a settlement agreement and requested the opportunity to continue those discussions. The parties’ request was granted and the discussions continued outside of the presence of the Administrative Law Judge.

Following the discussion, the parties advised that they had reached a resolution of the matter in dispute, however the terms of the resolution would take time to complete. The parties requested that this matter be continued and set for a written Status Update.

Therefore, good cause appearing, the hearing in the above-entitled matter is continued and set for a written Status Update on February 7, 2025. On or before this date, the parties are advised to do one of the following:

Inform the Tribunal that the matter has been satisfactorily resolved by submitting a Motion to Vacate the hearing;

Inform the Tribunal that the parties need additional time to resolve the matter by submitting a Motion to Continue and reset for Status by 30-days, 45-days, or 60-days; or

Inform the Tribunal that the parties are unable to resolve their dispute and request that the matter be set for hearing.
