On March 12, 2025, Respondent filed a Motion in Limine, requesting issue preclusion under the standard of claim preclusion. Complainant failed to Respond.

The hearing will be limited to (1) the at-issue materials or services rendered (the work); (2) amounts owed for the work; (3) payments made for the work; and (4) payments made to Respondent and Respondent’s capacity to pay.

IT IS ORDERED the Motion in Limine is denied.

IT IS ORDERED the parties shall meet and confer and file a joint statement addressing all of the work and related payments, setting forth stipulated facts about the work and related payments or, upon disagreement, short statements (not to exceed 50 words by each party) explaining each party’s position.

IT IS ORDERED the parties shall be prepared to make arguments regarding whether, in the event that Complainant prevails, ordering an offset to the default judgment would be an appropriate disciplinary alternative to ordering payment.
