COMPLAINANT, ORDER VACATING HEARING v.

Scott Brown Gschwend,

RESPONDENT. The continued hearing in the above-captioned matter was scheduled to convene on July 1, 2025, at 9:00 a.m. On the date and time set for continued hearing, Assistant Attorney General Charles Hover III represented Complainant Arizona Registrar of Contractors (“Registrar”). Investigator Barry Maerker appeared as a witness for the Registrar. Respondent Scott Brown Gschwend appeared on his own behalf. Prior to the commencement of the hearing, Mr. Gschwend made a Motion to Continue the hearing. The Registrar objected to the Motion. The Motion was denied as this matter has been pending for almost one year and has been continued five times. Thereafter, the parties participated in a prehearing discussion outside of the presence of the Administrative Law Judge. Following that discussion, Mr. Gschwend made the decision to withdraw the appeal filed in this matter. Based on the withdrawal of the appeal, IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings. IT IS FURTHER ORDERED remanding this matter to the Registrar for further action.
