Minute Entry

The undersigned Administrative Law Judge, having reviewed the document Motion to Withdrawal State’s Exhibits and Seal [sic] as filed by the Arizona Registrar of Contractor’s (“Registrar”) on June 21, 2024, makes the following minute entry:

The Registrar’s motion is denied. There is no statue or other legal authority that grants the Tribunal lawful ability to “seal” proposed hearing exhibits or other correspondence received from litigants in a docketed matter before the Office of Administrative Hearings (“OAH”). However, understanding that confidential information was unintentionally submitted in one or more exhibits submitted by the Registrar, OAH will permanently destroy proposed hearing exhibits received from the Registrar June 14, 2024. No copies will be retained for any purposes, thus making it impossible to issue any copies subsequent to a public records request. Therefore,

IT IS ORDERED that the Registrar shall resubmit all proposed hearing exhibits for the above-captioned matter, and redact all personally identifying information that would otherwise be deemed confidential.

IT IS FURTHER ORDERED that Respondent shall destroy exhibits received from the Registrar on or about June 14, 2024, including any and all copies disseminated to third parties.
