ORDER RE: RESPONSE TO OBJECTION TO CONTINUE
The Office of Administrative Hearings is in receipt of Complainant’s Response to Respondent’s Objection to Motion to Continue. Complainant asserts that “Respondent’s counsel recently submitted documents and materials that were not previously available to Petitioner. These materials require sufficient time to review, organize, and assess for relevance and accuracy.” These materials were provided by Respondent to Complainant on November 17, 2025, electronically via a Sharefile link contained in Respondent’s Prehearing Disclosure Statement. The documents filed on February 12, 2026 clearing state: “PLEASE TAKE NOTICE that pursuant to A.A.C. R4-9-118(A), Respondent . . . previously complied with the deadline to disclose its witnesses and exhibits for hearing on February 19, 2026, by filing and serving its Prehearing Disclosure Statement (“Disclosure”) on November 17, 2025. A true and correct copy of the Disclosure is attached hereto for the convenience of the Office of Administrative Hearings and Administrative Law Judge, as well as all interested parties.” (Emphasis in original.)
Therefore, Complainant has had since November 17, 2025, “to review, organize, and assess for relevance and accuracy.” There is no newly submitted evidence. The documents submitted by Respondent on February 12, 2026 are duplicates for convenience purposes. Moreover, this matter has been pending before the Office of Administrative Hearings since September 2025.
Good cause has not been demonstrated to continue the hearing. The hearing will convene as previously scheduled.
