HEARING

On July 18, 2024, Respondent’s counsel filed correspondence with the Office of Administrative Hearings in which he stated that he received an email from Complainant setting forth that Complainant wished to vacate the scheduled hearing and close the filed Complaint. Attached to Respondent’s counsel’s correspondence was the email received from Complainant that reads as follows:

Mr. Dunmire, all items on the punch list have been completed except the marks on the marble. Efforts to resolve that issue have failed and we will live with it. As such we believe this matter is closed. I assume you will notify the State that we see no need for the hearing tomorrow to proceed.

Based on the above, and sufficient cause appearing,

IT IS HEREBY ORDERED that the hearing in this matter is vacated from the calendar of the Office of Administrative Hearings.

IT IS FURTHER ORDERED remanding this matter to the Arizona Registrar of Contractors for further action.
