ORDER VACATING
HEARING
On April 16, 2024, the Arizona Registrar of Contractors (“Registrar”) issued a Notice of Hearing on Contested Case (“Notice of Hearing”) in the above-captioned matter which set an administrative hearing before the Office of Administrative Hearings (“OAH”), an independent state agency, on May 29, 2024. The issue(s) to be determined are whether the Registrar has cause to discipline Respondent’s license based on the following alleged statutory violations:
Charge 1: A.R.S. § 32-1154(A)(20)
At the time scheduled for hearing, the parties participated in an informal settlement conference. As a result, the parties entered into a settlement agreement that included the following terms:
Five (5) days after the effective date of the Final Order in this matter, Respondent J.D. Remodeling LLC, ROC License No. 337494, shall be suspended for thirty (30) days;
Five (5) days after the effective date of the Final Order in this matter, Respondent shall be required to furnish the Registrar with sufficient proof that its construction contract(s) comply with all requirements set forth in Ariz. Rev. Stat. § 32-1158(A),
Respondent shall be required to pay the Registrar the sum total of five hundred dollars ($500.00) as a civil penalty pursuant to Ariz. Rev. Stat. § 32-1154(E), and
If Respondent fails to pay the entire amount of the civil penalty on or before thirty (30) days following the effective date of the Registrar’s Final Order, the Registrar revoke Respondent’s license, effective on such deadline date. No future license shall be issued to any entity consisting of persons associated with Respondent, as defined in Ariz. Rev. Stat. § 32-1101(A)(5), unless Respondent tenders payment of any outstanding prior civil penalty.
Based on the foregoing,
IT IS ORDERED, pursuant to Ariz. Admin. Code R2-19-111(1), that Case No. 2024-01899 be vacated from OAH’s calendar and remanded to the Registrar to issue a Final Order consistent with the aforementioned terms of the parties’ settlement agreement and any other terms it deems appropriate.
